JOHOR BAHRU – Mahkamah Majistret di sini hari ini melepaskan tanpa membebaskan (DNAA) lelaki warga emas yang tular kerana menampar seorang pemuda bukan Muslim di kedai serbaneka sebuah pusat beli-belah di sini, Ahad lalu.

Keputusan itu dibuat Majistret A. Shaarmini selepas pendakwaan memaklumkan untuk mengklasifikasikan kes tersebut sebagai DNAA untuk dirujuk ke Ibu Pejabat Peguam Negara (AGC), Putrajaya ketika prosiding sedang berlangsung.

Terdahulu, orang kena saman (OKS), Abdul Razak Ismail, 65, telah membuat pengakuan bersalah, namun tidak mengakui fakta kes yang dibacakan jurubahasa.

Sehubungan itu, Shaarmini menolak pengakuan bersalah OKS dan memerintahkannya untuk melantik peguam bagi membela diri.

Bagaimanapun, sebelum tarikh ditetapkan, Timbalan Pendakwa Raya, Nur Fatihah Mohd. Nizam memaklumkan pihaknya menerima arahan untuk merujuk kes tersebut kepada ibu pejabat AGC.

Majistret kemudian memerintahkan kes itu di DNAA terlebih dahulu dan akan dituduh semula pada masa akan datang.

Berdasarkan kertas pertuduhan, Abdul Razak didakwa telah dengan sengaja mendatangkan kecederaan kepada seorang pemuda di sebuah kedai serbaneka sebuah pusat beli-belah di sini pada pukul 3.45 petang, Ahad lalu dan dia didakwa mengikut Seksyen 323 Kanun Keseksaan. – KOSMO! ONLINE

yep, AGC mistake. But don't simply accuse the judge, he's just doing his job properly 

why dont AGC check everything before go to court?

yes, and he stood at court without lawyer, which is a big no-no. Definitely need a lawyer, even govt appointed one, because everyone has the right to be represented

Not really ah. Some cases also got no lawyer but the major thing for this case is the fella contest the charges instead of just pleading guilty and accept the punishment.

because the accused is not represented by any lawyer. Later if cincai pass out verdict like that, even more hoohaa will be made, unfair this unfair that, then go to appeal court and the decision overturned because not following due process. I'm pretty sure you guys don't want that either
