If I was being held lockup for 3 days and then release afterward, will it count as criminal record?

And when finding new job and the company perform background check will they found out and will it affect their impression on you to decided not hiring you?

No. Doesn't affect in anyway.

And congratulate on the experience.

Only if you have been formally charged as a criminal and there is a record of it. Most MNCs and financial services companies are unable to hire you if you have a criminal record.

If you have been just remanded, for investigations or having your statement taken, then you are fine as this is just a process.

Only if it formally charged - meaning that 3 days were the sentence by court. Then would be difficult to work with big companies.

Being in lockup for remand or wait for trial is not considered as it is not the sentencing.

It's best to clarify with the police if that's consider as criminal record. Then, when there is such question in the interview, best to clarify, even if there is no criminal record.

Just say like "no criminal record, but was held in custody for 3 days due to.." then tell them you were young and stupid then.

It's always good to be truthful.

i notice for some china man companies here, they make u sign up an exclusion to the PDA contract that allow them to hire private investigators to track all aspects of ur background.

wonder will this affect or not.

If they take the effort to do that, it will probably affect your ability to get the job.
Those background check companies are not cheap.

Of course I know that many companies are doing. Heck, for one of my jobs I had to go all the way to Putrajaya to get my Certificate of Good Conduct from the Foreign Ministry Department. At the same time in the past, I constantly work with HR for my hires as well on their background checks. Not only for criminal record, but credit check, bankruptcy, affilliation to political parties/royalties/shady organisations, and more.

Not intrusion at all. When one applies for a job and depending on their process, you are basically subjected to their tnc when they request for information from you.

There are also industries that requires further info/declaration to be submitted to the relevant agencies like BNM etc.

For banks, it is mandated by Bank Negara so if you feel that your privacy is intruded on, feel free to not accept the job

if to check credit rating that's fine by me.

but some checks are not only before you join the company, but they will keep doing checks on u even after u joined the co.

also they will check if you had legal cases, how many car accidents u had (is that really relevant ?), how many properties you have.

Yes, also directorship in companies, shareholding in companies (especially more than 25%), anti money laundering (AML), as well as background references (HR will call all of the previous companies you have reference and speak with HR there as well).
Credit rating is the least of your worries unless you were declared a bankrupt. But for financial institutions, BNM (Bank Negara) wants to ensure that all staff has the highest minimal standards to prevent future legal issues, integrity and also conflict of interests.
