 Accumulated Leaves when leaving company

Hi folks,

Say I have 10 days earned but unused annual leave at the point of leaving the company, should the company compensate for these? If yes, is there any particular way?

1) Pay in cash
2) Offset with notice period
3) Offset with buyout penalty
4) Company does nothing and don't offer any of options 1/2/3

2) This is more likely to happen
3) This is a case-by-case process
4) Also likely, refer to your employee handbook

2) Normally company just asks you to take a leave with the remaining notice period
3) why want to reduce the buyout penalty if the next company is going to pay on your behalf?

Do you know that, under Employment Act 1955 Section 60E, unused annual leave if not being utilised, the leave entitlement will be forfeited at the end of year? No carry forward, no cash replacement.

Surprise, surprise, there are so many good companies in malaysia.

I encountered few situations before ya.

1. They requested for me not use my leave & I was properly paid for all the days that I worked during the period.

2. Fully utilised all leave so they calculated a last day in the office.

Sometimes, in some company handbooks, they don't really mention this sort of finer details because its on a situation-to-situation basis (such as ongoing projects, training needed for anyone taking over the work etc) so by the end of the day, its still between your HR and direct boss to work things out.

Talk to your HR will be the best. If option 1,2,3 are not available, then perhaps can negotiate with Hr again.

in my past employment experience, option 1,2,3 is all possible. depends on how you want to use the earned leave.
