 Commerical shop lot can be used for residential?

May I know if commercial property with 1st and second floor, can be modified to be stayed overnight and if it is legal?

I think no issue. Many traditional family use to run the business on ground floor & stays at the upper floor. The only set back, you cannot complaint if noisy due to commercial activity / no car park because it is not meant for residential at the first place.

No, not for these two purposes. Someone who rented it and use for residential and made complaint to Health department that the operation affected his health.

No you can't. It is made known the surrounding operation is for commercial, the complaint will hold no water legally / from town council. It will closed as "no further action".

i see.

i dun think the health department going to care about his complaint since he using commercial unit as residential.
there is a reason why it is designated as a commercial unit in the first place.

its funny that guy think staying in commercial units will grant him the same privaleges as a residential unit.

Unless the owner have approval from the local authorities, they can't.

I have a unit on commercial which i convert to student dorm/living area. I need to send architect plan to local PBT and Bomba for approval.

Snap photo with evidence. Write in complaint to town / city council . Building usage is under the town/city council jurisdiction.

Yes, I got my approval but its not easy since i have to prepared proper safety measure with the recommendation of Bomba.

Actually can for higher requirement building to be used as lower requirement building. If you want to use lower building requirement to higher building requirement , then it will not be allowed.

Residential to be used as shop - cannot. Because shop have higher building requirement.
Shop to be used as residential - no issue but the user cannot complaint why the surrounding don't meet residential's requirement.

As I know why the shoplot can't be used for residential, as it doesn't rumah emergency exit door at the belakang if it is 1st floor.

Not necessary & it don't hold water. If it is not safe for residential for such reason, it will not be safe for commercial either. Like I said previously, to use higher building requirement for lower building requirement - no issue. To use lower building requirement for higher building requirement, it will be an issue.

Residential is less stringent when it comes to fire requirement when compare to commercial.

An example of modification from less stringent building requirement to be used as higher building requirement - to use corner lot house as taska / tadika. Original dwelling unit is less stringent, when owner want to be used it for tadika / taska purpose, the additional safety escape like staircase to external from L1 are needed.

For the shop unit to be used as residential, the existing fire escape already complied with higher requirement for residential use. Hence, there is no need further modification / enhancement needed.
