Sinking fund and maintenance fees are not unlimited, JMB cannot willy-nilly spend tens of thousands or even hundreds of thousands on repair work, they need to answer to the owners as well.

If some litigious owners founnd out the JMB spent huge sums to repair what turned out to be developer's fault, the JMB will be sued pulak.

For her lawsuit, apparently in 2017 she lost a case and now she bringing up another case but developer issued a notice to declare her bankrupt unless she says them for the defamation claim for 2017 case. Basically to stop her new case.

She went with sohai Siti kasssim in 2017 and lost the case. Hiring the right lawyers is very important for these cases bro. I think now she raise another case since she got new evidence to back up her claims now based on her latest FB post

minta bearbearwong to give opinion on this case.

1. Is there anything a owner can do to fight for this case? Seeing that the property suffers from visible defects due to poor design from the developer side, yet they are not holding themselves responsible and rectify the problem.

2. What can home owners do if they are faced with this kind of developers (after they've purchased the house and signed the SPA)?
