I think your view not entirely correct. They declared 10% higher so that buyer can enjoy HOC. They dont get any additional revenue as buyer still paying low price. You have to look at it positively that the market value of the house is actually 10% higher than advertised price then you are getting 5% additional discount out of it. The effective price / sqft of the unit is lower than most of apartment around setia alam anyway.

For some reason, i could not find any clause about force majeure in the SPA..can someone check and confirm which clause?

And according to the link below, if there is no clause, developer is still obliged to deliver within 36 months subject to negotiation with purchaser. If they delay, is there any clause in the loan agreement that we are not obliged to settle the monthly interest fee?

Deed of mutual covenant DMC is agreement between developer and purchaser related to the use and maintenance of all the shared and common facilities under stratified property. Not related to the sales and purchase of the unit and obligation for developer to deliver VP. So force majuere under DMC is not applicable here.

That one i think bind to DMC with respect to management of the strata properties.

As long as it is within 36 months from the 1st SPA signed i am OK..otherwise we shud fight for our rights.

I think parking assignment has been pre determined by developer..for example example those at high floors especially the ones with 3 parking got parking at levels with the connecting bridge, so easier for them to just drive to their parking then straight to lift to their house..and those at lower floors will get parking at higher levels.

I have emailed developer that I take note about the current issue that could cause delay in delivery of the project. However, since this may also affect the buyer as buyer will incur additional cost for interest payment, also prolonged rental of rented house, buyer may also observed our rights as stipulated in the SPA. Suggest you all do the same so that developer still commit its best to deliver as per SPA.
