Yes, I have encounter the same payment as well. My agent told me it can be waive by negotiating with your developer, but it could take a while to process.

He suggest if the amount is not much, it's better make the payment so you can get your key earlier.

The late payment you can dispute one. AK always ask people pay one
Ask your lawyer do chronology of event. See who fault.
Normally if bank fault, bank will bear or AK will waive some or all one.
Ask agent help to follow up
