well, the recent amendment to the strata titles act, all subdivided properties must form a Joint Management Body(JMB) within 12mths of the vp.
JMB is a body corporate which comprise the developer and purchasers. Duties of JMB are as follows:-
1. Maintain the common property
2. fix and impose charges for the maintenance work
3. insure the building
4.prepare and maintain a register of all purchasers
5. ensure the building mgt fund is audited
6. make house rules and enforce house rules
therefore as purchasers you will have your say coz you will be part of JMB committee member(joint management committee(JMC)).JMC shall consists of developer and not less than 5 and not more than 12 purchasers. So, purchasers have a greater voice and have the right to amend /change / make the house rules of their building.

but 1 thing i wish to bring to your attention is does anyone of you check with the architect of the project that borang E being submitted? coz only borang E submitted to Majlis Perbandaran Selayang and MPS accepted than only the developer can hand over vacant possession.
coz VP does not give you the right to stay in, only with CF issued then only can move in. therefore collecting key is just to view on the house and u still hv to wait for the CF.

I will tell you the experience of my friend, another victim of the developer.
My friend and her uncle bought a terrace house with this developer, spa is 24 mths to hand over. they got their VP letter on the dot of 24 mths.
so they are happy and went to collect keys. her uncle is cash buyer and she has bank loan, so the dev send her vp letter only but send her uncle with billing & architect cert.
Added on January 9, 2009, 9:15 pmafter they collect key, her husband found something strange that the dev not claiming their bank. so he called to dev to verify, so d staff gave him all d excuses. after few mths, only d dev claimed their bank, so my friend called to their bank and req for a copy of archi cert, to her surprise, d archi cert is not as same as her uncle. date is not right, d archi cert is so much later, so she went to tribunal to claim for LAD, coz she knew that d dev is cheating them by sending the fake archi cert to avoid compensation. Immediately after the dev receive her n her uncle tribunal claim, they called her to settle silently. paid to her and her uncle whatever she claim.
