hi, found a buyer for my 330k landed single storey house. Low cost house, free hold.

My buyer told me to just use her lawyer so that I can save cost and ease of transaction, but I worry if I don't get my own lawyer, I will be at risk, is this worry justifiable? Or should I just use her lawyer?

My agent went to a few law firms and we got quoted 5k for legal fees, roughly around there, feels a bit too much for me, almost the cost of agent's commission alone hence would like to seek advice here..

should I look for cheaper lawyers?

or the lawyer fee is reasonable?

or do I just use buyer's lawyer?

any comment would be greatly appreciated

DO NOT USE THE BUYERS LAWYER.
i cannot emphasize this enough.

why?

y so exp? i sold my prop for 440k only cost me 1.2k..
confirm agent gets the commission....
try find lawyer yourself without going thru the agent..

later the lawyer add 1 small disadvantage clause u oso dono...

then when something happen only u know.. oh... thats what the clause trying to say...

then u regret using his lawyer

buyer lawyer = buyer friend = anything goes wrong seller gg.

all the lawyers will say no conflict of interest one yet ask you to sign waiver for them to represent both parties.

because anything goes wrong.. the lawyer always on buyer side..

thus best is using different lawyer.. anything happen can rectify whose fault..

i have 2 lawyer contact for my two house purchase.

1)Very cheap but service SLOWWWW.. (My 1st house stamping 50% weaver refund after 1 year also haven get, due to they forget apply for me)
2)medium range but service very good.. all conversation documented and official email send out..

Lawyers simply cannot act for both parties, either for contentious or non-contentious matters. They will be in breach of the Legal Profession Act 1976. The clause stating that the lawyer does not represent both sides is usually in the agreement; it is also in a policy enforced some years ago by the Malaysian Bar.

the buyer lawyer will side to them, use own lawyer

Never Use buyer's Lawyer or agent'S Lawyer. I have friend using agent'S Lawyer and Later found out the Lawyer is sucks to the maximum. Never Once update My friend and My friend complaining to me. Last2 found out the agent took commission from the Lawyer.

I will always Use my own Lawyer in dealing with property. He will always update on the status of the case via email together with letter informing What He has done Everytime. Anything You dont understand Just Whatsapp him He will try to explain Why it happens. Reliable and trusted Lawyer.

im pretty sure your 1.2k 'lawyer fee' is only for filing CKHT / discharge for u and the lawyer is not acting for you in the transaction, unless the lawyer is ur fren and do FOC for u.

dont because of want to save few thousand end up u risk getting ur money delayed or the lawyer pass file to clerk and do and screw the deal up.

basically if you want to choose lawyer, you only can pick 2 out of the following 3

1. cheap
2. fast
3. good

cheap and fast wont be good
fast and good wont be cheap
cheap and good wont be fast

basically if buyer n seller share same lawyer, on record the lawyer can only represent one party in the transaction.

in this case, since the "SPA" legal fee (the fee that follow purchase price of the property) is not billed into your bill, means the lawyer billed the buyer the "SPA legal fee", which means he is acting for the buyer on record.

the lawyer is only helping you to do the discharge (bank settlement documents) and filing the LHDN forms for this transaction and technically you are not represented by any lawyer in this deal.

Why ah? I know people who disposed a RM12.5 mil property but used the buyer's lawyer. Buyer is a rich man btw.

Generally its safer to use your own lawyer to ensure that your interests are protected - that too if you get a good one not a pariah one..)

However, there are exceptions to the rule if

I) you are conversant/familiar with all legal jargon and can vet the sales and purchase agreement yourself comfortably..

II) or you can get your friend lawyer to help you vet it ..

so you actually save on the legal fees to hire a separate lawyer for yourself..
