My family has been getting harassed by this guy in our neighborhood. Car tires has been getting punctured frequently and multiple deep scratches on my car. The last time he did it, the CCTV evidence apparently was not enough and did not show his face, which is why police couldn't do anything. This time, I have finally managed to capture his face and caught in the act...!

The sad part is that this guy is now the President of the resident association in the housing area I live in. Due to the fact that I'm living in a guarded community, I see no reason to pay the "security fees" anymore. They even threaten to completely stop my family from entering our house if we don't pay. What joke is this? Scratch my cars and demand protection money? It's clearly a voluntary payment fee as the guard house was set up a year after I lived in this neighbourhood.

Any /k expert in law can tell me what can I expect from the police this time and will he be punished? Is there a website to check on whether my resident association is legal or not? When we bought the house it was classified as guarded but not gated. Since then they added boom gates and auto gates. I'm living in MPSJ area (Puchong) btw.

just report police and get this guy a punishment. Fuck if he does that to my car I will fucking burn his house

you have to lodge police report as reference if this might involve court case later. you can also lodge report to local city council where you live. they have the authority to take action. there is a t&c by city council where people cannot be forced to pay security fees. but they are encourage to do so for their own good too.

Will do tomorrow, the guy even had the balls to send me an email demanding payment with words like "we cannot guarantee your safety and will not be responsible if anything happens to you or your family"...

I just hope the police and the investigating sergeant will layan my case this time. I don't think I'll be joining their association anymore, I couldn't be damned if I have to go through the boom gates and register every time.

Btw, security fees are RM150 per month and their annual statement says that they have over rm70k in cash surplus. Surely some law prevents such big amount of money to be in a resident association??!

The only interaction with him was when I first moved in to this neighbourhood 5-6 years ago. The guy was trying to plant a tree in front of my house and ask me for permission to use my land with advice from his "feng shui" master which said our house is blocking their "feng shui" with negative energy. Needless to say I told him to plant in front of his own house because he's crazy.

Really shocked that he is now the President.... Guess he's having a power trip and trying to revenge? I really wonder what can they do to force me to pay. Destroy my car some more and burn my house?

Collect opinion and find out residence sentiment.
If in you favour, plan your tactic.

Unfortunately this guy is actually quite popular among the committee members and neighbours... he always like to use our residence funds to give neighbours who volunteer to do work like decorating the garden with "complimentary token of appreciation, 1 year security fee payment waived with no cost". We can't object since the committee does the voting and people here don't feel anything wrong with that.

Only thing left to do is hope police will take action or I'll post his face with video evidence scratching my car in the residence FB page.

i don't like ppl who don't pay their security fees but anyway, just check ROS if the RA is registered.

as much as it pisses them off that you are freeloading on their 'security', they can't criminally intimidate you.

just file a police report, and complain to MPSJ as well as RA complaints are also under them.
in such case where we know the RA has a lot of spare funds, usually we try to band a majority of residents together to petition to reduce the charges temporarily until when needed again or amend the constitution to lower the max ceiling or approval etc.

In your circumstances you have 2 choices : move or realized this man weak point. He is superstitious & a bully. He knew how to buy heart of ppl. These ppl sadly are not able to see thru him as well. As such u will not be getting their supports coz you didn't benefits them & that Bully did but of course not his own money!!
I get ie pay someone to gently harrass him BUT at same time i shall innocently spread news of getting a "bomoh" to venge those who bad u. As such make sure the ceremony is dramatic/theatrical enough for all to notice especially that bully! He shall go to bed very worried.

Update: made police report, handed over the CCTV evidence and they will summon him to record his statements. Will see how it goes...

Update 2: Police informed me that the suspect denied that he scratched our cars yesterday. The suspect is requesting to meet us in the police station, for unknown reason.

Sigh should have known that this case won't be solved so easily...

I don't understand why he would request to see me. Anyways, I discussed with my family and we decide we won't confront him, since he denied already he will probably just accuse me of pointing finger at him without evidence. The Inspector told me police can't do anything anymore because the camera angle can't see his "weapon", even if his hand is extended the argument can't hold in a court case.

Now I have spread the incident to my residence road WhatsApp group, fortunately he only kicked me from the main group. I asked them to help share the message, I'll see what else I can do.

I still have the video with his face left as my poker chip. Although it's not enough evidence for prosecution, it's more than enough if I viral it... Now I have advantage, I'll see his actions before confronting him.

Update: Went to MPSJ and met with the perancang Bandar that's in charge of my district in Puchong. After his investigation, it seems that the resident association in my area didn't even bother to apply for permit to set up guard house and Auto gate system. He said the threat to stop me from entering the neighbourhood is blatantly illegal and I don't need to bother paying any amount that I owe since they have no right to even accept payments.

He asked me to lodge a letter of complaint and sent it to him direct so that he could take action and "saya akan pergi roboh guardhouse kalau dia kacau u"... And he said he will be calling up the committee president to question him.

Guess I don't need to worry about them trying to make my family's life difficult by wanting us to register as guests every time we want to enter our neighbourhood!

He's a good guy. But I'm not sure if he really called him to give warning though. I'm always sceptical of Malaysia's civil servants in government sector... PDRM also same. Sometimes they all talk but no action. Frustrating living here sometimes.

Update: So far MPSJ has done nothing to the illegal guard house, but they didn't cut my auto gate access like what they threatened to do.

I just received their latest Audited account report that they give to every resident, and the committee now has RM110K cash balance... I don't know why they need so much money and why people are still happily paying rm150 per month.

In the AGM minutes, it seems that they syok sendiri propose and self approved a motion to waive security fees for the whole AJK (president , treasurer, secretary etc). Means the residents will pay for them... Yet no one complained.

Oh well, police can't do shit, MPSJ can't do shit, all I need is him provoking me one more time and I'll print his face and spread the video of him scratching my car.

At least I'm not paying anymore. They can do whatever they want.

When I delivered the stuff to your house last month I was admiring how atas your security was (although your housing area is within another housing area). Never expect got this kind of psycho in your kind of neighbourhood. My place is unguarded and has a lot of gila people (being a low cost area, expected) I keep aiming to afford a neighbourhood like yours one day and end up seeing this thread.

P/S: I'm a law student and am quite sure with sufficient proof you can threaten to sue him in tort. Perhaps you should consult your family lawyer?

Well let me tell u in closely guarded neighborhoods, u will usually have a resident committee that will feel they are powerful just because they have some control over the security guard/policy etc those that cannot tahan power will be corrupted soon enough. In my case the President is already a crazy person, so he is now comfortably using his position to act like he controls everything here...

Yea the police advice me to consult civil lawyer since they said not enough evidence to press criminal charges... But will see how it goes, if he does anything again then can't tolerate anymore and must punish him.

MPSJ sent me the Selangor guidelines for Gated and Guarded Community. For individual land title properties, Illegal and legal security schemes cannot force anyone to pay, or block house owners entry to residence.

Auto boom gates are only allowed if 100% residents agree and subject to town council approval. Fencing is not allowed unless obtained approval.
