But during the brand approval stage, consultant reject the brand that I listed on SOP and ask for etc brand not listed in the SOP during Tender stage. Can a consultant change the brand after award to us and sign LA ?

well, GST is in fact make the account more transparent no doubt. alibaba meaning middle man that not carry out reall 0 work. example government award to Rashid (who own a company have less than 5 staff), and Rashid award to IJM (main contractor). so IJM will help Rashid do all the job. IJM even use Rashid company cover letter to write letter on behalf of Rashid. this is alibaba. whatever money IJM claim on behalf of Rashid, Rashid take a cut. this is the meaning of alibaba.

of course there are lot of contractor decide to close shop, some is due to complication of GST, some of course yes, it will reveal more thing. other reason is also because of the payment of GST, the time gap hardly meet. cashflow is very important for contractor. so sometimes u have to pay the GST in advance even though u haven't claim back. those are also risk.

I assume u refer to public project. for public project, in term of morality it should be award to lowest bidder because it's people money. this clause "we have the right not to accept lowest bidder" doesn't mean u can award to higher bidder. this clause merely enable u to award to higher bidder with reason. when u award to higher bidder, u have to give the rigid answer to public.

but if u ask my personal opinion, I think no matter what government also should award to lowest bidder. because prior a contractor able to enter the tendering work, they have to pre-qualify themselves that they had meet criteria to tender this project, eg. like they have satisfied the financial capacity required, they have sufficient manpower, they have XX years of experience of etc. once those criteria met, I think there are no much reason not to award to lowest bidder among all qualified contractor.

but of course still got exception, eg. some contractor they bidder slightly higher, but they propose a even shorter duration of project, so why not? eg. a contractor propose 6 months earlier than the lowest bidder at 10 million cost expensive, so this 6 months can generate more than 10million for LRT project, why not? good reason.

to current government, all these clause simply abused by them. not a shocking thing they twist this and that and claimed they comply to contract and done nothing wrong

if the open and transparent tender is truly adopted, those company that are fully occupied won't even qualified to tender the work. in fact on paper alibaba is now allow. because u can't sublet the entire project to other contractor in most of the standard form of contract we commonly used. well written in the contract subletting entire project is prohibited.
