Look, I think most here have the wrong idea on how things actually work regarding criminal cases in Malaysia.

1. Police investigates, but the power to charge lay with the AG chamber. That is why you get statement from the police such as "We have passed the file to the AG chamber." That means I have done investigating and have passed all the relevant information to the prosecutors of the AG chamber.

2. There are two stages - remand order, which the police applies from the courts is to detain the suspect pending investigation. Even at this stage, the police has to prove to the courts that there is probable cause to detain, and when a remand order is given, it is very specific on the time. Normally, if there is a case, the guy will be produced in court and charged.

3. Depending on what section he is charged with, there is no such thing as paying a fine and leaving. One guy I handled before got the shock of his life when he was given a 1 year jail sentence because some idiot told him that was what the courts will do. What is the penalty for the charge he is under? If it has a prison sentence (or even mandatory prison sentence), then there is no such thing as paying a fine and leaving.

4. Most cases are bailable offense, excluding death penalty cases such as 39(B) ADD or murder. There are some so special circumstances (even though I only remember 1 case), but most of the time you can be bailed. Unless you are Pablo Escobar or Mona Fandey.

5. There is no such thing as kawtim la. Public cases, too many avenues for complaint. What normally happens is the star witness withdrawing their report or in a lot of cases decided not to come to court. I already lost count how many police personell that got charged in my court (which is not even in KL).

thanks for the clarification, it does help alot.

However may i know what else we can do at the moment? The IO did not take or submit the rest of the people's report to the AG, that means they will only know about my case which the amount is not too high compared to some other victims.

I believe he will be charged under section 420, cheating while impersonating. But because i did not get any updates or news, i dont know how is the progress of it at all.

Anything that we can do?

Usually the criminal will bully or threaten you. It is easy because he already have your particulars. He also now knows your face. That is why I am saying TS is a hero if he proceeds until the end.

So all we can do is wait forever? Well thats sad, looks like all the effort is a waste of time?

That is the stupidest thing that a criminal or a bully can do. One simple police report means he has another charge coming. The courts also do not take kindly to these kinds of attempted witness tampering. Too many avenues for the authorities to proceed.

It is not about forwarding the cases, compiling them together and presenting it to court. Believe it or not, we in Malaysia do operate on an "innocent until proven guily". You are charged on a single offence, and rarely does a case is presented in multiples except when the offence is conducted from a single static place (such as HYIP cases) or involve the same persons (both victim and accused) in multiple transactions.

No, no need to wait forever. You just need the right kind of pressure. Before you do this, one very simple advice. KEEP CALM. We have to work within the confines of laws and procedure, and we have every interest in removing these type of people from society. Let the wheels turn.

Ask the IO this - Was he charged in court? If so, which court?

In a perfect world, your statement might be true. But I am afraid we live in the real world my friend. I know of a lot of people who succumb to dropping the charges or being a witness just because of this.

My friend who hit a snatch thief with his car and foul a mat rempit's attempt at a local Tesco finally drop his charges. You know why? Because the culprit knows his face, car plate number and even his house. The fella was not alone, he has a gang and my friend has a family. If he is single and living alone, that might be another story. He can take the gang vandalising his home or car but he wouldn't forgive himself if anything happened to his family.

Why or why we don't have a police line up like in the hollywood movies, where it is anonymous. Our police lineup is face to face.

Witness protection program? You speak up and you will end up being thrown out of a multi storey building. Don't tell me you guys forget already. I pity the fiance and family.

Sorry to keep everyone in suspense. I did not reveal too much info here because the case already brought to court. Do not want to be said to be giving out sensitive information.

Btw i just got a call from IO that the case will be heard in court in May (date to be confirmed). I have been called there as well as witness.

let me reveal more after the court hearing as to not allow the culprit to use any info from here to use it against me to get himself free.

Do feel free to come support if you are a victim or just wanna support me to get the guy punished.

Latest check have shown he has not repented and continued to scam people around. Does not justify that this guy deserved to be forgiven.
