or the

Q2: for the "insurans and kwsp", is it a total of the KWSP contributed by employee as per the EA-form and also the personal insurance paid annually?

have a question. referring to the attachment, i have highlighted in a box the part which i do not understand.

assuming my chargeable income is RM21,000, this means I fall under the 6% bracket. Which means I have to pay RM1260 (before RM400 rebate). But my question is, what is the RM300/RM900 shown in the box I highlighted. Not quite sure how to apply it.

If your taxable income is RM 21k:

QUOTE
First 20k == 300
The balance 1k at 6% = 60

Total is RM 360

QUOTE
If your taxable income is RM 35k:

First 20k == 300
The next (balance) 15k at 6% = 900 (15k * 0.06)

Total is RM 1200

First time filing with a child here. I have some questions I hope someone here can assist:

1. My wife (she's working) and I are filing separately
2. Our son was born in 2013.

Question:
1. Under children relief, which do I fill in? 100% or 50%?
2. Who should fill that in? Myself or my wife or both fill in for 50%?

BTW, it's the same child.
*
It's advisable for the one who is paying for more tax to file for full 100% children relief.

Alternately, both of you can file 50% each if I'm mistaken.

dear all,

I got a friend who is leaving Malaysia for business trip for a few years. But his salary still paid in Malaysia. But his service is for other country. Does it means he still need to pay tax in Malaysia ? He is working in a OHQ company in Malaysia.

> If a Malaysian who is residing and working in either Australia or London provide consultancy services in his personal capacity to a company in Malaysia and his services are paid to his bank account in Malaysia, is this income subject to income tax? If this income is below RM25,000 a year, does he have to report his income?

As he is likely to be a non-tax resident individual in Malaysia, his income from consultancy services will be taxable in Malaysia provided the services are performed in Malaysia. The payer is required to deduct 10% of the gross amount payable and remit the amount withheld to IRB. The withholding tax is a final tax and fees received need not be reported in a tax return.

Same article from The Star:

QUOTE
> Currently, a tax payer can claim refund of the income tax deducted from dividends paid out by listed companies. What about withholding tax deducted from dividends received from Real Estate Investment Trust (REITs) institutions? Can a tax payer claim refund of the withholding tax deducted?

If a REIT has distributed 90% or more of its total income as dividend to the unit holders, the REIT is exempt from tax. The dividend declared by the REIT would show a withholding tax of 10% in the case of an individual unit holder. This withholding tax is considered a final tax. The dividend need not be declared in the Return Form 2013 and no refund can be claimed.

Would like to ask, last year I resigned and join current company, therefore I have 2 EA form. So for income tax, I have to submit twice or just once for the 2 company ? Coz from my first "Maklumat Individu"  it only shows one employer number.
*
Combine them into one and put the latest employer in the Maklumat Individu section.

may i know "who is paying more tax" means wat?
1. who got more taxable income, or
2. who still need to pay tax / who need to pay more tax after all the tax relief and tax deduction?

if both husband and wife can get tax refund (got overpaid tax), then better gv who?
*
My reference to "who is paying more tax" is "who is earning more and paying more tax before any relief deduction" - higher taxable income

The purpose of the claiming eligible relief is to reduce your taxable income and that will translate to lower final tax paid (need to pay).

sorry for repeating the question again.

Say a person is listed as a 'director'of a company..

does he 'carry on a business' or 'not carry on a business'?
*
Q1: Who needs to furnish Form B?
A1: Form B needs to be furnished by an individual who is resident in Malaysia and carries on a business.

Q2: What is the difference between Form BE and Form B?
A2: BE Form - income assessed under Section 4 (b) - 4 (f) of the Income Tax Act 1967 (ITA 1967) and be completed by individual residents who have income other than business.
Form B - income assessed under Section 4 (a) - 4 (f) of the ITA 1967 and be completed by individual residents who have business income (sole proprietorship) or partnership.

Q33: If I started a sole proprietorship in 2010 and I was a director of a private limited company, do I fill out two separate forms for reporting these two sources of income?
A33: You are not required to fill in two different forms. You just need to complete Form B 2010 because you have business income in the year 2010. Statutory business income should be reported in column C1 while income from employment as a director to be reported in column C10.

If you have a tax income file opened, just file it even though your income is not taxable.

@J_pandapuppet, you can put back-dated incomes from previous years at first page under "Pendapatan Tahun Kebelakangan Yang Belum Dilaporkan".

Since you have actually paid the tax via monthly PCB deduction and if you don't have any business income, I don't see the big deal. In the case of being audited, you can bring along the previous EA forms to support your case.

Try to submit last year and see if LHDN ask you to declare other years or not. Try to slow talk with them when they send you a letter. It can avoid you to pay penalty but the amount you owe still have to pay.

Not the case, you still need to do the paper works. As PCB usually are deducted based on gross income. Especially if you have some side incomes(OT or bonus), then it will affect your PCB calculations also. Like mine, this month I only pay rm400 of PCB, next month I may need to pay rm3000 of PCB, just becuase of OT and bonus bank in together.
*
The EA form will have each of the details including OT and taxable fixed allowance. This is the only proof or paper work for employment income and I did mention in my post "if you don't have any business income".

If you have business income, this will be out of scope.

For filing back dated incomes, you're not allowed to claim for relieves.

Let the tax officer perform the assessment, he or she may be called for a coffee session at the tax office.

Rebet and reliefs are our EPF, insurance, books that we bought. Or some have bought house also entitled for extra rm10000. This is all PCB never calculate before. That's why we need to fill in the e-filling
I got missed out rm6000 of EPF, ended up I need to pay rm1500 extra on top of PCBs I paid.
*
Do you think that I'm THAT stupid and not aware of those things?

I'm talking about "Pendapatan Tahun Kebelakangan Yang Belum Dilaporkan" and NOT about current year of assessment. How many times that I have been stressing this.

Under "Pendapatan Tahun Kebelakangan Yang Belum Dilaporkan" section, you can only put "Jenis Pendapatan", "Bayaran Pada Tahun", "Amaun Kasar" and "Caruman Kumpulan Wang".

As I mentioned earlier that, when you're filing for un-filed back dated or previous years income, you're not allowed to claim for relieves.

If you have BUSINESS INCOME, that is another separate different discussion.

Guys, I understand that company handphone and petrol allowance are exempted from tax.

But where do I key in those amount in the BE form? Should I just deduct straight from my statutory income?
*
No need to deduct or key in anywhere in the BE form.

Make sure that your HR put that amount into the Section G of the EA form under tax exempted BIK.

QUOTE(SpectacularButter @ Apr 25 2014, 12:55 AM)
The section G in my EA form is empty, but I have a letter from HR stating that xxx amount of allowance money was for company usage. Can I deduct this amount from my total amount in EA form?
*
Does that amount appear in the Section B of the EA form? If yes, you should ask your HR to correct the EA form.

Any amount appears in the Section B are taxable.

If no amount at Section B, just ignore it.

I've been doing this for 4 years, never have problem, books, sports equipment is used to "balance" my tax return, such that I pay them some extra or they pay me back some.
But make sure you don't claim maximum on them.
*
I really hope you won't call for the audit.

We don't encourage stoppy to do that.

Of course, the final decision is still on you.

LHDN is very strict this year.

Hi, if I bought my house on 2012, am I eligible for the tax deduction on the house interest? I see that the the BE column stated only for 2009-2010 house. Please help.

Isn't the prerequisite for eligibility is so clear and straight forward that the S&P must be signed in between 2009 and 2010?
