At 6.15 a.m. this morning (28 September 2013), as usual, I was woken up by Yarl restaurant's loud kitchen hood noise again. Yarl restaurant made noise until 11.00 p.m. last night (27 September 2013) and this morning the loud noise started again as early as 6.15 a.m. This means that its victims are only allowed 7 hours and 15 minutes of sleep today - far from what is recommended by the health authorities. Though I tried to cover my ears with two pillows, I still couldn't sleep even though I am very sleepy and that's why I am writing this letter.

Since Yarl restaurant started operation in January this year, it has become a great nuisance to everyone in the neighbourhood. The reasons are clearly stated in two of my earlier articles namely "Serious Noise Pollution in Brickfields" at http://forum.lowyat.net/topic/2951694 and "A Letter to Datuk Seri Najib Tun Razak" at http://forum.lowyat.net/topic/2962198

I have read about the operating hours of the restaurants in many countries. According to the laws in these countries, the restaurants are only allowed to operate from at 7.00 a.m. until 10.00 p.m. on weekdays. On a Sunday, the restaurants can only open at 8.00 a.m. because it is understood that people will sleep late on a Sunday. But for yarl restaurant, there is no such thing as Sunday. On Sundays, as usual, it will set its natural alarm clock early in the morning to wake everyone up. How come Yarl restaurant can operate in such an uncivilized way? How come Yarl restaurant can operate whenever it wants at the expense of others? Looks like it has the intention to open round-the-clock in the future. It if wants to make loud deafening noise, go and find a place where it's not facing anyone's bedroom windows. Why put the kitchen hood in front of people's bedroom windows and make noise all the time waking everyone up so early in the morning?

The painful truth is Yarl restaurant's victims have no freedom to sleep when they want. We do not dare to sleep late, dare not watch midnight movie, dare not go out late at night because we know that Yarl restaurant will wake us up early. Does anyone have the right to order people when to sleep and when to wake up in Malaysia? Even our Prime Minister Datuk Seri Najib Tun Razak does not tell us when to sleep and when to wake up. How would the Malaysians react if our beloved Abang Najib were to tell us to sleep at a certain hour and wake up at a certain hour each day? How would the Malaysians react if Abang Najib were to say that we are only allowed 7 hours of sleep each day? But it seems that Yarl restaurant is given the right to tell its victims when to sleep and when to wake up. To impose a rule on its victims telling them when to sleep and when to wake up is a gross violation of human rights. To make loud deafening noise all the time making it impossible for its victims to go into their bedrooms when Yarl restaurant is operating is a gross violation of human rights. Who has the right to ban anyone form entering their rooms for 17 hours a day? It seems that Yarl restaurant has this right. To pollute the air with curry and making our clothes soak with curry each time we put them out to dry is a gross violation of human rights. Who has the right to pollute the air with curry? Again it seems that Yarl restaurant has this right? The question is who has given Yarl restaurant all these rights?

Below is a photo of Yarl restaurant's kitchen hood that is continuously emanating loud, deafening noise to disturb the neighbourhood and churning out curry particles to pollute the air. This morning (29 September 2013) the restaurant started operation at 6.30 a.m. I only managed to get 7 hours of sleep because the restaurant made noise and operated until 11.30 p.m. last night (28 September 2013). Why complain? To endure 17 hours of loud, deafening, and continuous noise from the kitchen hood that causes the whole building to vibrate is more than what an ordinary man could bear. The noise is seriously affecting my health. I can't focus on my work because I am tired and don't have enough sleep. After a stressful day's work, I only come home to be disturbed by endless loud and deafening noise. I can't even think properly nowadays. I am writing this because my rights as an ordinary citizen of Malaysia is seriously infringed. What is the meaning of "rakyat diutamakan"? I don't even have the right to sleep peacefully for 8 hours each day. I have a house but am homeless. What is even worse is I cannot say anything or do anything about it. To all those who feel that I shouldn't make noise about this issue, are you also trying to imply that the Bukit Merah victims and Lynas victims should also shut up about their situation if they can't afford to move elsewhere? In other words, are you trying to say that the poor who can't afford to buy another house because the house that they are living in has become totally uninhabitable (because someone has just set up some kind nuisance business there) should accept their fare and suffer silently?

TS, if the restaurant's back side is facing your bedroom window ... you're living in the first floor of a shophouse aren't you? Where else do you want a restaurant to operate from if not a shophouse?

Until his problem is solved? Which means never. That problem will never be solved here. He'll just keep starting new topics, instead of posting to the ones he already created earlier.

I tried to be understanding and not say the obvious thing earlier. But it's getting irritating with him starting so many new threads, so after this, everytime we see him starting a new one, we'll just ask the obvious question. Perhaps it's TS who should move. If you can bear the noise, don't stay on top of a shophouse in a commercial area. Go rent a house in a nice quiet suburb, of if you cannot afford that, get a flat on the 16th floor.

It is a commercial building. What do you expect? I live next to busy highway. Tidak kecoh pun saya. Maybe you can invest in good pair of ear plug or noise canceling earphone.

I'd rather live next to a busy highway, noisy school, or a noisy market. I wouldn't mind at all. It is the vibration that comes from the kitchen hood as though an earthquake is imminent that I cannot endure. You think I have lot of time to write? I have a lot of things to do. I would rather be a Lynas victim than a yarl victim. At least I don't have to feel sleepy and tired all my life.

What if you live in a commercial building and your neighbors turns on loud music 17 hours a day non-stop? In actual fact, I wouldn't mind if my neighbours turn on loud music 17 hours a day. I can endure loud music. Music helps to soothe the mind. It is the motor sound vibration from the kitchen shaking the whole building that is causing me headache everyday.

This is the way to complain when your most basic rights are seriously infringed and you cannot say anything or do anything about it.

Even you own a shoplot in a commercial area, it doesn't mean that you can do as you wish and disturb the neighbourhood 17 hours a day with incessant noise. You can only do what you want as long as you don't disturb others. As simple as that! The purpose of my articles is - I want the human rights activists throughout the world to read about the kind of rights that we have in Malaysia. As a start, I am not sure where to write. Better start a blog about human rights in Malaysia in the near future.

I don't live in commercial building. And I would remind you that you are given a pair of leg. Please move to other place if condition at your existing place is so 'no-for-human-live'. Unless, you own flat that you currently living in.

I own the flat. I can't afford another one. If I have the money, I would certainly move away. This flat is totally uninhabitable by normal human beings since Yarl restaurant started operation in January this year. Prior to that, there was pindrop silence in the mornings and nights. Even the afternoons were ok and can be very quiet at times. Now the place sounds more like a noisy factory for 17 hours every day.

My neighbours have made countless reports to DBKL but nothing has been done so far. I won't be surprise if the DBKL officers are taking bribes from the restaurant owner. After all, Malaysia is known as one of the most corrupt nations. They only thing that DBKL can do is summon them...and the owner keep pay...they got money.

If you have heard about downtown in damasara there alot worst. Luckily the downtown close after alot of pressure from people leave there.
