Just want to bring to attention a fraudulent car dealer located at No 55A, Jalan F, Kg Pandan Dalam, 55100, Selangor.

I paid a deposit of RM1k to TIMES AUTO ENTERPRISE for a car they listed on Mudah.com/Carlist.com/Autoworld.com

MAZDA 2 1.5L Sedan WVR 4070
Mazda 2 1.5 (A) - Cars for sale Kuala Lumpur - Mudah.my
http://www.mudah.my/Mazda+2+1+5+A+-21659211.htm

A few days later, as agreed, I went to take the car to my mechanic for a check. Upon arrival at Times Auto, I found the car stalled right in front of their driveway, unable to move with the timing belt off! A mechanic was called but I arrived just as the mechanic came. There were also 2 additional dents on the front door on both sides of the car and a large stain on the front passenger seat which they attempted to wash off but couldn't.

The car sales persons (MS SALLY WONG and MS MELISSA LOW) informed me that the car died after she came back from the accessories shop, which was also where the doors were accidentally dented.

As the condition of the car is not in the condition I booked it, I requested for a refund from the company but the owner of the company, MR LIEW TECK MENG (https://www.facebook.com/liew.t.meng) was dishonest and rude. He kept changing his story and insisting that the car has absolutely no problems and he himself took off the timing belt himself because he was adjusting it. sleep.gif
(Who would purposely remove the timing belt of a car? And right in front of their driveway, blocking all the other cars!)
Regardless, of the reason for the timing belt being removed, the car was not able to run when I went to collect it. Hence the company is required to refund my deposit.
However, TIMES AUTO ENTERPRISE has refused to return my deposit as they claim insurance and road tax have been bought and they have put in labour and services to arrange these things. But I have called the insurance company and they have no record of any insurance purchased for this car or under my name. (Even if the insurance have been bought, it can be transferred later, I think) Anyhow, the complaints tribunal inform me that I am not responsible to bear the cost of this. I have not even signed anything!
When we tried to negotiate for Mr Liew to return at least a bit of our deposit, he insisted we actually need to compensate Him instead for the labour and services he has done. (refer to the ridiculous calculation he MMSed my husband in the pics below)
Upon being contacted by the NCCC (National Consumers Complaint Centre), Mr Liew insisted that this company has been liquidated and he has registered a new company - Jolex Auto Enterprise and hence he does not need to return the deposit anymore. (But according to SSM, the company is still registered??!)

I hope nobody will get conned by irresponsible car dealers and fraudulent company! I probably won't get my 1K back but I hope others will BEWARE OF THIS CAR which is most likely problematic and not get cheated by these people from Times Auto Enterprise... sad.gif

Bro, I think you have the right to consult a lawyer in suing the used car dealer. RM1k is not a small sum but not big either but it will at least give them a warning that they are not above the law.

Clearly there is a fraud or misrepresentation on the condition of the car. You are entitled to get a refund for the deposit

The cost of court proceedings will be high.. So we filed a complaint with the consumer tribunal instead.
But this man is a smooth talker and just insists his company has been liquidated.
When we threatened to expose him and his company, he just told us to "do what you like"..
We have sent the Form 1 for the Tribunal court but no reply so far..
They are just basically ignoring us.. and probably trying to sell of this car to the next unsuspecting customer..

I presume you have a receipt for the RM1000 deposit paid? Hence i don't understand why you need to "negotiate" although the guy insisted that you compensate him. Obviously this is a cut-throat used car dealer, not ethical. As what others have mentioned. Go to small claims tribunal. Chances of you getting your claim back will be high. NEver mind if the guy didn't turn up or reply. If they don't reply after you have submitted the form to them within the stipulated period, the tribunal will give out the jury to your favour.

Guess some of the used car dealers will need to resort to such tactics to avoid losses being in this business. Unethical and unprofessional really, and the consumer shall not be liable for any costs incurred for a lemon that shouldn't be sold in the first place.

If no receipt for the RM1k deposit, then maybe can walk away. If yes, then I don't see why the OP shouldn't pursue on this matter. I have a receipt for the RM1k.
And when we booked the car, we started the engine, inspected the car and checked under the hood, but we were not allowed to take the car for a test drive as it was "company policy" to only be able to take the car out once we have paid deposit. So, we paid a deposit and arranged a date to take the car for a check with our mechanic. They assured us we could take the car to our own mechanic and they would refund if there were any problems.
We were a bit too trusting as well, I guess. *sigh*

So when we went back just a few days later, that's when we found the car stalled in front of their gate..
The company insisted I take the car as it is or else compensate them for the work done.

I have sent the Form 1 for the Tribunal court via posdafter aku terima. But I am still waiting for the confirmation card that my letter has been received.
They are capable of purposely not accepting any registered items as I have already threatened to go to the consumers tribunal.

When the NCCC called him to discuss on our behalf, he just insisted that the company has already been liquidated. NCCC then said they will not pursue further as it is like claiming a debt from a dead person. Totally not helpful.. Especially since I have checked with SSM and the company is still up and running.

Even if we win the tribunal court.. What if they just continue to ignore and not pay?

I TOTALLY AGREE. There are a few of them operating from Klang and Kajang too. Some of them think they got enough foreign workers to show their strength. In my sister case. she called the polis when the entrance of the dealer office was blocked by men after she test drive the car. They pretended my sister agreed to buy the car. She was pressured to sign some forms and tried to walk out.

isn't it an enterprise company is same entity with the biz owner? then even he has the biz winding up also useless.
for private limited company then it is limited liability to that company only.
however, if that's any loan application from this biz owner, bank will check why they are biz being wound up
please check with CTOS on how can you put up his name at the Trade Reference column to make him tougher to apply any loan from any banks

You got to analyse the situation. This case is different from Ah Long. You borrow money from Ah Long you are asking for trouble. This is a cheater case. Whether used car dealers employ gangsters(different from Ah Long) to intimidate the victim or not is irrelevant. It is certainly advisable that the victim pursues the case, exposes the culprit and highlights the case so everyone will be aware of the unscrupulous business ethics the used car dealer has resorted to.

This does not apply to used car dealer cases only but other businesses. It all cheaters are thought to have gangster back-up and the victim does not intend to follow up on his misfortune being cheated by one, everyone can become a cheater then since nobody would care to lodge a report.

Actually your sister does not need to be pressured to sign the forms. If the workers still block your sister from driving out through the entrance, she can stay put in the vehicle, keep it locked from inside and then call the police. I am quite sure if the workers (or the boss) noticed that your sister is using her phone to make a call, they will let your sister go. They won't be too brazen to damage your sister's car on the spot. If they did, then they are just tarnishing their own business on a higher level.

That's why I'll NEVER purchase any of my cars from used car dealers as there's always a saying in the trade, "11 out of 10 used car dealers are super conman!".

I know there are some dealers who are honest but probability is hyper low. If I'm not mistaken, this Liew's Jolex Auto Enterprise located beside the Tesco Extra roundabout in Cheras, heading towards Yulik & Cheras Leisure Mall.
