I am worried now.. AFAIK custom kernel (abyss, perseus, redpill, neak) and 4.1.2 stock kernel have this fix in place. You also need the fix for recovery. Safe recovery are 4.1.2 stock recovery, and latest version of TWRP, Philz, Abyss recovery.
