No worry, its residential title for resident units.

Commercial title is applicable to shop unit and office below.

Because its is on a commercial land, hence the developer applying the concept of SERVICE APARTMENT to have resident unit on this land.

Thats the trick they use. From year 1995 until 2007, Service Apartment is not governed under HDA Act. Loophole for developer to built something that can claim fast MONEY.

This is what i heard from the SA about the title thing.

They mentioning the Land Office is accessing this.

Im still checking with my town planner consultant regarding such possibility on combo title

parcels need to remain designated as commercial however. Upon applying for strata titles, developers may apply for the title's conditions ("syarat nyata") to be converted to containing residential apartments ("bangunan kediaman") as well as shops.

That way, the rate applied to these apartments is a mixed rate ("kadar bercampur") which is less than the rate for commercial shops. "To do this, they just have to pay a nominal additional premium of RM100," says a spokesperson in the strata title department of Selangor's land and mines office.

There may even be a 50% reduction in chargeable quit rent if the number of shops is less than 2% of the number of homes, eg two shops underneath 200 apartments. Alternatively, these shops may be assigned as "common areas" of a condominium, in order to fully designate the development as residential.

When the time i learnt in college, my lecturer already start telling about this service apartment as loop hole to evade the HDA requirement for billing to purchaser before year 2000.

Service apartment was previous designed as a Hotel concept with retail below and cleaning / laundry service just like a normal Hotel would do. But its allowed the developer to sell out the unit to public while complying the regulation and restriction for a commercial land development. Bear in mind, it should be small size layout like a Hotel which something like The Herritage is adopting (Fully furnished).

But soon after year 2005, developer start getting greedy. come out the idea for service apartment with large layout. They want more profit and easy marketing. This intimate the HDA and trigger the impose of HDA Act to any new service apartment there after.

But this does not stop the developer cracking their heads. Then SOHO, SOFO and SOVO came out like mushroom to evade the HDA Act.

Again, SOHO is officially governed under HDA Act since 2012.

Rules and regulations keep changing. End up, we as end user had bear all the cost implemented.
