Yes, you still have to pay lawyer fees even when it fails.

But you can appeal again many times, it is very troublesome.

Guess you should get experience lawyer to do the appeal for you (The lawyer need to write a long story to convince the land office that the owner seriously and urgently need to sell off the unit and need to provide lots of document to prove it). Booking fees = property agent don't pay back, (that's why never sell your property through agent)

Deposit = seller pay back buyer (10%) if not successful
