Medical/Hospitalize Leave, Advise needed

I undergo a nose surgery on Feb, My doc said i admited inpatient so it consider hospitalize leave, my doc gave me MC from 4th feb - 5th March i back to work on 5th march because my company forced me to do so, now they deducted all my MC entitlement, my AL and unpaid, On my contract it stated my entitlement for MC = 14 days Hospitalize leave = 60 days
my question is am i considered on MC or hospitalize leave? i understand if i go for outpatient it will be considered as MC but in this case they deducted all my AL
pls advise

if a doktor give MC its an MC, or hospitalise in ur case if u can show proof of admission
in any case the problem is they cannot deduct ur AL cos ur HAK to get MC/Hosp as long as document in place

they said since its only a medical leave certificate it will be counted as medical leave !!! what is hospitalization leave then ?
Added on March 8, 2010, 4:24 pmI did provide my admission letter, i was admited on 4th Feb and discharge on 8th feb, my doc grounded me to stay home until i fully recovery, i did provide my medical report from the hospital to my comp, but they said they consider that as MC and since MC entitlement is only 14 days they have to deduct the rest from my AL
pls advise

no i havent finish my sick leave, they deduct 14 days from my MC entitlement, 1 day from my AL and 3 day Unpaid leave.
i wonder what is the 60 days hospitalize leave? what is considered hospitalize leave? is it only when you sit in the hospital bed? or its considered if you go as inpatient?

u need to consult ur company medical provider or HR. most cases where a person is hospitalise, they do not get hospitalisation leave due to lack of documentation or improper process followed

i did provide all the documents, moreover my company is the one paid for the surgery first before claim from insurance

Yes as my understanding that what my situation should be, but in my case after providing all the documents my HR still dont count it as Hospitalize leave ! if like this until end of this year if i really fall in sick my MC will be considered as unpaid as they deduct all my MC

employment act 1955, section 60f (bb) u r entitle up to 60 day as certify by medical practitioner.
challenge them on this.

It could be a few days warded plus a few days resting at home, can consider as hospitalization leave. If it's just a medical cert, then it's consider as medical leave. If you have hospitalization leave, they must deduct from the hospitalization leave entitlement 1st. If you over shot that, then they will deduct the medical leave and if you over shot that too, then will follow by annual leave and last is unpaid leave. could you explain more on the 'force to come back to work' part ? I think no company have the power to force an employee to work when he's on MC. If something bad happens to you while you are working, you could sue the company. Refer back to your doctor and him/her to write you a letter saying that you are not fit for your job for that whole month and states clearly to "rest" at home.
hospitalization doesn't meant that you need to be in the hospital for 2 months. Challenge your HR and say that you are going to refer the case to labour office.

I've spoke to my doctor, he asked me to come on Wednesday with my MC and he will write me a letter, About forcing to come back to work part, My MC is until 5th March however my comp forced me to come back to work on 1st March with excuse there's lot of pending work, I did told them i have a follow up checking on 4th and need to remove scabbing from my nose and im not in a good condition to return to work, However they asked me to come to work on 4th after seeing my doctor, Which i did go back to office on 4th March

do u have any document with the word "hospitalisation" on it from the medical practitioner at all? i belive that may be the issue here

so far i dont have that, i submitted the MC, my admission letter and other reports, im meeting my doctor tomorrow to sort this

i think there lies ur problem. despite physically going hospital, there is no document from doktor to say u r "hospitalised" hence ur HRclassify as Sick leave
|

the proof of admission not considered as hospitalized? also the surgery report?

best to let the doktor write that letter to indicate hospitalisation, then discuss wif ur HR.
FYI i myself no hospitalisation leave in my contract. sigh.
