Hi,

I have accepted a job offer and pass the medical check-up and even signed the letter offer. However when I tender my resignation, my supervisor decided to retain me by giving me a counter offer. After some consideration, I've decided to stay at current company.

My question is, what will happen if I call up the new company's HR and tell them that I have changed my mind? Am I subject to any legal action?

According to my supervisor and friends, there is no such law in Malaysia. Is it true?

Thanks.

1st .... wat u signed should only be offer letter.... under the offer letter , there should be a clause stated the probation period (unless u are applying for top management post) . Then under the probation period , they will state the notice requested for u or ure new company to give notice in advance before u can leave. So meanwhile i believe there are number of days which u have to serve for notice before u can go. Either u can pay back a sum of cash = of no of days which the notice required.

They'll send you a lawyer letter asking you to pay back the RM100 or so for the medical checkup. Just ignore it. I did that last time. They're not going to haul you to court over RM100. LOL.

VinluV: Yes, I heard that I'll be blacklisted for maybe 1-2 years by thier HR.

flyyy9501: Hmmm.. I am not worry about the notice period. I am more concerned about FFK the new company.

Matrix: True also. They are not so free to haul me to court I think. Hehe...

Thanks for all the inputs. smile.gif

read the offer letter you have signed and see the terms carefully to see how much you have to compensate if you don't turn up at work on the first day. Ask your current company to compensate for you because they counter offer you!

Refer to your Contract of Service (CoS) and speak with the HR Department pertaining the matter. Don't complicate yourself by Law itself before hand.

well TS, if i were you, this is what I would do.
Call up the new company and tell them that your x-company has counter offer you and you plan to stay back. Tell them your are sorry and etc. That's it.

They won't bring you to court or whatsoever just because of you. Furthermore, the new company might want to counter offer you tongue.gif

Just called up the new company and explain your situation, suggest that you would bear the cost of the medical check up. Good luck,

Do keep in mind that in cases where the candidate applied for jobs online (e.g. using Jobstreet), there is a closed feedback loop in which prospective employers grade their hiring experience. I attended a SIVA briefing once, and Jobstreet told us that candidates that ditch or dishonour appointments for interviews arranged for them etc get a *permanent* blacklist. That means if you have ever failed to show up for a job interview etc. it will be noted in your online records and the next prospective employer that accesses your electronic resume will know if you have a record of "fishing" (not seriously applying for jobs). It reflects on one's (lack of) integrity.

Dont be so dishonest when applying for jobs. The company have already offer you and you sign on the LO. If you been counter offered then tell the truth.

Call up the company said you been counter offer and you will bear the medic cost. Just like one forumer said.

You are now a working professional. You still need us to teach you what to do whats right? Dont be so brainless can? If you are below 20 I can understand. Above 20 plus still dont know whats right and wrong. Something is really wrong with you.

you should have forseen that applying new job mean moving up the ladder!

it show that the new company are willing accept you with new improve salary adjustment.
But it also show that you display lack of foresight by showing or sowing bad faith using their job offer as a form of leverage in getting an improvement salary or benefit in your current job.

My question, why apply for new job, attend interview and sign up the new contract which is agreeable to both parties and reject it later?
it show that you have bad faith blinding by monetary value simply.

The question is why suddenly your current company only adjust your benefit/salary after knowing that you got better offer outside?
It also show that there is no future in your current company coz they only counter offer once you are more that ready to leave the company.

TS, one of the worst moves you can make in managing your own career is to accept a counter offer.
1: In the eyes of future employers, it means going back on your word and reflects on your lack of integrity. And as I mentioned before, nowadays, online job databases may keep track of such behaviour and render you less marketable in the future.
2: the present company that counter offered you will start to doubt your loyalty. In a worst case scenario, your manager may even be just buying some time for himself to hire and train a cheaper replacement for you.
I hope you think carefully and weigh all the pros and cons, and I don't mean just the monetary aspects

Which industry? Be very careful. In some industries, the business might be huge but the community is small and people talk. if ur credibility is tainted it will be with you for a while.

Dear TS,

You should read the Offer Letter. From what I know the company has rights to Summon you in court unless you settle with them an amount they can agree on.

However sometimes this does not happen. if put to perspective the odds are 50-50.
