Yes, do go and fire the heck out of the Nokia people and get a replacement... Lemons exist for all electronics (lemon = kaw kaw kenot help gila set), even for my M1210 a while back (so many lemons I tell you, lucky I got a good - not perfect, mind you - one)... And if you get one, YOU DESERVE a replacement...

But yeah, the Tube = low cost, high manufacturing volume HP... High volume = more chances of lemons, unfortunately... It's just statistics at work...

About the light leakage/gaps (a bit off topic, I know), THERE ARE some reports over at the Nokia discussion forums about the gaps being intentional, IE Nokia designed it that way to allow for better ventilation for the internal parts... Chips and antennae generate heat due to heavy use, correct? And the tube has 3G, EDGE/GSM, GPS, WIFI transmitters built in = gila heat generation...
After seeing my pal's tight no gap E71 becoming REALLY hot (the entire body) and dying repeatedly within a few hours while serving as a 3G-WIFI hotspot router (using Joikuspot) - and my Tube
serving for days on end doing the same thing (while only the battery especially becoming a bit warm in the process), I tend to agree with this, however unproven it may be.
SO, do you REALLY want your Tube to be screwed tight?
