U will fail to sue her under Reputation injury power . 1st you are selling item that not up to the standard as the picture u post . Buyer have the right to ask for refund. Otherwise she can sue you under fraud S.17 contract act 1950 (representor makes a false statement with intention to induce the representee to enter into a contract. So this contract is voidable ( buyer have the rite to terminates the contract when he or she find out there is fraud). The item is different from the picture and u have intention to cheat because as u know the item is different and u still wanted to send to the buyer. U are bluff the buyer to buy item from u with the picture provided in ur post. Please dont use the word sue as u like. thank
