I wanna get some advise here,

I work for my company more than 5 years. Recently i just pass my resignation letter to my HR dept, notice is 2 months earlier.. on 01/01/2013, i pass my letter and my resignation date is 01/03/2013... what my question is, i want to clear all me annual leave before leave my company.. i still have about 16 days annual leave... i plan to clear it off (plus my 2 off days per week) so i cant stop working before CNY. But the HR mention that they have RIGHT to not approved my annual days..

It is truth? or i have my rights to clear off all my leave?
*
Usually in offer letter or company policy stated they have the right to not approve your annual leave during your notice period. Talk to your boss and try to work it out, keep the good relationship.

QUOTE(cikut @ Feb 25 2013, 08:52 PM)
Hi There,

I've tendered my 1 month notice to current employer on last 14/2/2013, and at that time the HR and my boss accepted it and they even said congratulations, all the best, etc.

I've also signed the offer letter with the new employee, went for a medical check up, and should report for duty this coming 15/3/2013.

Today I got a call from my current HR and boss that they might need to reject my resignation, as they can't seem to find a replacement yet.

They even said, that in the staff handbook that the employee can't join any other similar business company, within 9 months after resignation.

Things that piss me off now, why bring this matter now. To find a replacement, is the company responsibility.

I'm gonna proceed with joining the new company this 15/3/2013. So do you guys think I will face any problem later? Will my current employer even sue me? I just to tired to think, so if they want to sue me, then I will just face it.

Any comment dear forummers?
*
Just join your new company and they can't do anything.
How they define similar business company? It is just a bullshit. If I am an auditor, is this means I can't be an auditor for 9 months.

Yes, find a replacement is the company responsibility. As long as you serve your notice period, then you can leave.

Reject resignation?! This is funny, you are not apply a job, it is resignation!!!
Although I feel your HR and boss are stupid to give a such stupid reason, but I suggest you talk nicely with them and sort this out nicely. Just to keep your reputation. Also, try to send email to them and get them reply you in black and white, just in case.

Good luck.

Thanks! Any idea about the bond? Anyone?

Logically I think it's fine, tendering is just an advanced notice, by the time I served the notice I would've completed the bond. Just need confirmation from experts or anyone from HR here. Don't want to ask my own HR because I haven't tendered yet.
*
Yes, it is fine. I had the same experience. My last working day was the last day of my bond.
I need to serve 3 month notice but i just gave 4 months notice and mention it in my resignation letter that i serve 3 months notice and completed my bond. tongue.gif

Can we pay 2 months salary and just quit the next day?

From my experience, the answer is yes but not sure it apply to all companies. I remember offer letter or HR policy do mention it.

My employment contract will be ending on the 31st Oct 2013.
According to my contract, I need to provide a 2 months notice.
Is is possible for me to tender my resignation on the 31st Aug 2013?
Or after my contract ends as it stated that I can't resign within the contract period.
Thank you.
*
Are you already decided to leave? If yes, you can just tender now. In your resignation letter, you can stated you will serve 2 months notice and also finish your contract as per agreed.

Hi, may i know the resignation letter should be given to my shift manager or HR? Then, should be send by email or print out the hardcopy for both HR and shift manager?
*
It depends on your HR procedure. I think most of the companies need hardcopy but i know some companies don't need it.

The standard should be:
1) Print out hardcopy, then you sign it.
2) Scan for a softcopy. Send softcopy to HR and your manager.
3) Pass the hardcopy to your manager.

Hi Faylo,

i have a similar problem with you. HR want to me to pay them 60k++ because i breach the contract.

After I signed the agreement, the HR didn't provide the training. Last thing i know i still bonded with them.

They put "subject to change clause" in the agreement. the agreement was totally berat sebelah.
*
I experienced the similar problem as well. Some staffs managed to resign without paying anything but I didn't take the risk and finished the 2 years bond.
Just take it as a lesson.

To me, bond is not a problem but need to clarify what I can get, how to void the bond and what if break the bond.

When I worked in Accenture, they pay me a certain amount of money and bond me a year. If I break the bond, just need to pay back the money they paid me. This kind of bond is acceptable and reasonable.

I already working nearly 4 month in my current job, the salary on time and their pay EPF,SOCSO.
But, I never sign any offer letter or any other letter from this company,
if I want to quit, can just I give 24 hour notice resign letter?
Do this company can sue me or anything? icon_question.gif
*
In my opinion, although you didn't sign any offer letter, but you are their employee officially as you get paid for 4 months.

Please be professional and don't ruin your reputation, follow the company policy and give required notice period.

example lets say in employment contract state that " you'll be getting salary rmxxxx and 13th month annual wage supplement".. been working 3 years, if tender resignation on 5th dec and serving 1 month notice, did he entitled for the so called '13th month salary'? thanks in advance..
*
It depends when company officially announce pay the 13th month salary. If company say due to finance audit, the 13th month salary only will be paid by March, then you won't get it.

I'm not gonna do that, just want to know.

So any legal action can be taken by employer to me?

But one previous  employee just give just 24 hour notice to quit.
*
I don't know. I guess company will ask compensation from you.

I have a question,

Say that your employment contract states that your notice period by both parties is 3 months but the company has agreed to give an early release  by just serving till end of the 1 out of 3 months. Does the company have to pay the other 2 months wages in lieu ? And if it does can you bring this up with them after say 2 months of leaving the company ?

Thanks in advance for your reply.
*
no, company don't need to pay the other 2 month wages.

QUOTE(JaneDoe25 @ Mar 15 2014, 04:10 AM)
Hi everybody! This is my first post here (and I really hope I chose the right section for my following problem).
I'm not from Australia, however, after a brief google research this forum seemed like a good idea.

Long story short: I'm in real need of an objective advice in regard to the following problematic working issue:

I work for about 3 years in a company where the boss (he) is romantically involved with a coworker (she).

My boss grants me trust in handling my tasks, appreciates the work I do (he is pretty much a good manager). His "secret" relationship with this woman is the problem: due to this, she can be a "dictator" (shout, treat the other coworkers like trash ..., makes people cry/ full of anxiety).

Today, her "being her" almost made me quit. I left earlier (excusing myself that I wasn't feeling good) just to calm myself and not say in her face the truth.

My problems:
1. Every time I want to complain to my boss about how she behaves he says "That's the way she is... ", or avoids the subject. She managed to convince him to fire two other colleagues that "undermined" her ...
2. I like what I do and my colleagues (her ... less) but I can't go on working with her.

So, I can't expect a solution from my boss nor continuing to ignore her behavior.

Should I write my resignation and "thank my boss and colleagues for the great period spent there?"
*
The only problem is 'her'? If yes, then just being honest to your boss and tell him that you will leave if he can't find a solution.
For me, I definitely can't ignore 'her' behavior and I won't happy to work in such environment for long term. If boss can't solve the problem, I will choose to leave. By the way, I always have no problem to look for a new job so I never want to work in a unhappy environment.
Hope my sharing help you. smile.gif

QUOTE(cku87 @ Mar 23 2014, 11:24 PM)
Hi all,

So I have a basic question. What is the meaning of 'pay in lieu of notice'. Ok the situation was my resignation notice should be 1 month but I requested to end it 1 week earlier and served only 3 weeks notice. HR did calculated for me the amount that will be deducted from my salary which I was aware of and have no problem with that.
So I guess I will have only 3 weeks salary coz they deducted the 1 week short notice. But it happened that they deducted the 1 week short notice from the 3 weeks salary. So its like twice deduction to my salary for the 1 week short notice. I thought I will be getting full 3 weeks salary since they deducted the 1 week already. When I called the HR said thats how the thing work.salary is salary and short notice is short notice. Though I still couldn't accept the answer due to the fact that they deducted twice of my salary.

Just to make thing clear here, is that how it should be done?
*
If I get it correctly, HR is right. You got 3 weeks salary and then you have to pay 1 week salary as a compensation to your company or it means you buy off the 1 week notice. That's why you get 2 weeks salary now.
Only you get 3 weeks salary if you use your remaining annual leave to knock off the 1 week notice.

This is my understanding. smile.gif

Hello guys. I would like to seek for advice here for my scenario.

I am a fresh graduate and applied at 2 mid tiers accounting firm while I have an interview at one of the big4 this Friday. Firm A gave me an offer and asked me to go work tomorrow and I accepted. What if the big 4 or Firm B (better firm with better offer) accepted me next week? What should I tell the HR that I want to resign after 1 week of working? As I know probation notice period is 24 hours. Urgently need advices thank you!
*
Maybe this is a common mistake from fresh graduate. If you still have another interview and you may accept the offer from 2nd company, then you can tell the HR give you some times to consider instead of accept the offer.

QUOTE

Depends how good is the offer from Firm B. If the difference is less than RM500 (included benefits, expenses like transportation cost to office, lunch, etc), I will stay in Firm A because I don't want give a bad impression to my employer. The industry is small, you might bump into the same boss/seniors again some days.

If difference more than RM500, then I don't care. I choose to gain my reputation later. tongue.gif

Just tell HR you got better offer.

Guys, can you give me advise on this situation ;

I am serving three months notice of resignation and HR already accept but they gonna hold my monthly salary until I complete all clearance form, surrender all employee n vehicle pass and pay the bond amount of 50k.

Note that I still serving the company for the coming three months

Q) is it legal my employer hold my three months salary becoz of this ? I think this is breach of contract by employer since I still coming n working @ office
*
If your 3 months salary is not more than the bond amount of 50k, I think it is make sense that HR hold your last 3 months salary.

Thanks for reply.

However, do they have right by law to hold my monthly salary until I fully paid the bond amount ?

Im still thinking by right Bond is separate subject against monthly salary.

I am not sure but I know my ex-company is doing the same way.

Hi, i have a question here. I have been working for 7 months now and i am receiving the confirmed staff amount of pay. But i did not sign the confirmation letter. Base on my appointment letter it is 2 weeks notice termination by both party before probation and 2 months after confirmation.

Please advise that which status i am in now since i did not sign the confirmation letter.
*
Did you receive the email from HR or your manager for your confirmation? If yes, even though you didn't sign the confirmation letter, you are considered agree/accept your confirmation as you didn't reject it.
Of course this is arguable but to keep your good reputation, I think you should serve the 2 months notice.

All the best to you. smile.gif
