I had a unit in blk d. From the day i purchase it in 2009 was told of the chinese temple will be relocated to give way for the swimming pool & blk c. My repeated calls to Taipan their reply was 'will shift next month' until now 2012, almost 3yrs temple still there. Why Taipan can't solve this!!! What they have to say about this!!!

We can work with Taipan to solve this plb.
But both Taipan & Syabas must remember that we are their customers.
And Syabas must remember deep inside that Taipan is their immediate customers.
May I request Mr Lau Weng San to let us know what is the actual Root Cause for Syabas to fail in delivering their services since Taipan has requested it Nov 2011?

Not only get the keys but also with the club house facilities or else Taipan Focus has to work out their proposal compensation scheme as our unit purchase is identified as a 'Condominium' & as I mentioned earlier from 2009 until today, the ROOT CAUSE in delaying in the club house is the relocation of the temple. For 3 years this also cannot settle.

Just to reconfirm, I checked my - Sales and Purchase Agreement and Deed of Mutual Covenants Property. My Lot D-XX-XX is identified as Condominium, Residency @Park51, Sungai Way, 47300, PJ, Selangor.

Oh! I know the SPA mentioned about this. Their catalogues, promotion documents all stated is with club house facility and we must receive this else need to be compensated. Don't you agree or else they will take their sweet time.

The SPA can be written as separate. We are not claiming the clubhouse but claiming our purchase comes with the benefit for the usage of this facility. That is what Taipan is promoting for the sales of this condo. Don't you think it's our right to do this?

Block D will be handed over first, A, B and C will probably be handed together with full facilities available by then. We can prepare the swimming pool for residence to use, but if anything happens, do the residence bare the consequences or developer? You also have to understand safety measures and protocols. The main question is, who will be responsible when something happens? We do see and discuss issues but rest assured, it's always for the best interest of our purchasers.
Block D was completed late last year as i have mentioned before. Just that certain minor issues in regards to insufficient of water meters from Syabas prevented inspection from other local departments such as Tenaga, Bomba, etc. But all inspection has been done and the CF will be out in a week or two time. Hopefully you and other purchasers will be able to get your keys next month.

doomdoom when i bought the condo, was told the CF issuance for Blk D includes the facilities. I think every purchaser was also informed the same. Now expected completion in 2014 we need to demand compensation.

What we need now is also the help from DAP Mr. Lau Weng San to verify this with MPPJ. Was there any amendment? Is the amendment due to the relocation of the temple.

As for the use of the swimming/club facilities...safety & security is everyone's top priority and no erection shall be done just to please us. We need an approved CF building/facility.

Want to sell says everything now can't deliver wants consumer to bare the cost? If make huge profits will you share with us?

I kept repeating is the Root Cause due to the delay in relocating the Temple!!!!!!!!!!! Solve it NOW, the longer the delay the more compensation to PAY.

Katijar, our maint fees is only for our block, if indirectly there is a contribution then Taipan should expedite the Temple relocation. Why make thinks so difficult to all, including THEMSELF!!!!

dun knw how many times i need to say..the clubhouse will be maintain by developer..t.he maintenance fee that residents pay will not use to maintain the clubhouse...and soemore if u wait more ppl to move in then only move in...but u need to start to pay installment..u can afford to pay installment but not move in to stay or rent out?... rclxub.gif

doomdoom, hope you can let us know where is this new temple, i would like to offer some prayers? when was the new location approved? what causes this delay?

I am sure it is not because of the new place that the delay take 3yrs. I would think everyone knows, to relocate a temple it's not just pack and go, but lots more example choosing the perfect date, time, prayers for many days etc... there are more to this & only Taipan knows.

Anyway, a delay is a delay and Taipan is responsible.

I am just curious regarding the CF & like to know more. I just read thru' the SPA & the Approved Building Ref. No. = MBPJ/120100/T/P10/714/2007. I've ask around and my developer's friend told me this will be the scope/coverage for the building CF issuance (whether it covers the clubhouse or not).

Are you able to find out about this?

See again postpone, from after CNY-Feb to Mar to Apr & now to May..will this continue. By the way, who is Simon?

I had received an email reply from Syabas yesterday and they had requested some information which I had provided to them (details of the developer & condo) for their investigation except for the water account number (13 digit) & details of Taipan's application which I do not have. This will help them to check with the respective department and to get the right information back to me.

Let's see what will be their reply.

Great!! So far we have walle, khyuen, pong85, maxnergy, anokcow and so on who will fight for compensation if club house facility not ready when hand over keys. I had check with some lawyers and they said we had the right to request for compensation...as it is the club house, facilities & pricing (if without this, just like some of us says it's a flat) that attracts the buyers to purchase. This are all in their websites and brochure.

We should not except free water supply as this is peanuts.

The development unit just received photo of individual meter repair work from consultant (PL Liew) on 27/4/2012. However, for your information, hand over process is still in site commentary stage. There are several stages more that need to be completed.

By the way, thanks for coordinating this.

Pls inform to Mr. Lau when having the meeting in MBPJ to also discuss on the compensation for handling over without the clubhouse facility. This I had confirmed from the lawyers that handle the signing of our S&P for Park51 the parcel of Block D is inclusive of the Club house facilities.

You (or everone) may contact the lawyers that handle yours.

Remember, this is to protect buyers who wanted to sell or rent their units with a lower price due to our condo now is an apartment/flat.

You are right & I do not denied that The Club House, Swimming Pool, Gym & Other ClubHouse Facilities are not part of the Common Facility as mentioned in the S&P (as these are open to public membership by Taipan) but is a part of the 'accessory parcel'. You may read your S&P Section 35(a) Interpretation for 'accessory parcel'.

Remember the sales in promoting Park51 is with these facilities & the price we paid for is equivalent to other condo ex. Zen during year 2008-9. Anyway, as mentioned earlier, the Lawyers that handled this S&P also said we are entitled for this compensation.

I hope everyone is clear about this!!!! Let's gather together for Bersih Park51. OK. TQ.

Thanks for the pics & infor.

Maybe Taipan is using Syabas as an excuse for the delay, instead of the temple. The coming meetings between Mr Lau, Taipan & MBPJ the truth will be reveal.

Doomdoom hope you can attend. I will try, most probably can't as I am not a KL guy.
