SHAH ALAM: A Nepalese man investigated for sodomising a cat was fined by RM40,000 in default of 15 months' jail by the Sessions Court here yesterday.
Judge Nor Hasniah Ab Razak handed down the sentence after Arman Shah, 43, after he pleaded guilty to a charge of cruelty mistreating a cat
The former security guard, who is single, was charged with cruelly abusing a cat on the fourth floor of an apartment block in Kota Kemuning, Section 31, at 12.30am on Nov 15 last year.
The charge was framed under Section 29(1)(a) of the Animal Welfare Act 2015, which carries a penalty upon conviction of up to three years in prison or a fine not exceeding RM100,000, or both.
Based on the facts of the case, a woman who had just arrived at the car park and was in her vehicle saw the accused holding a cat and pulling down his trousers before carrying out the act.
The woman asked her husband to reprimand the accused. Upon reaching the area, the complainant's husband also saw the accused naked.
After being reprimanded, the accused put his trousers back on and threw the cat downwards before entering his rental home.
Arman is currently also serving a four-month prison sentence for the offences of being partially naked in public and entering the country without valid documents.
