Because it's two different thing. That's why I said read what TMJ say, he is talking about the technicality of things and avoiding saying the legitimacy of the document. And this will be likely the argument FAM will plan to take in CAS. It has nothing to do with innocence because this is not an argument about nationality etc.This is why I don't understand Fuzzy argument.

I'll break it down the likely argument in CAS:
FIFA: Malaysia cheated - here is the birth cert of the grandpa from Dutch
FAM: No we did not - here is a legal birth cert as issued by the government of Malaysia certifying grandpa is Malaysian.
FIFA: Cannot, we will use the birth cert we found from Dutch
FAM: Cannot, you have to use the one submitted by us - which is legit because it is issued by the government of Malaysia thus making him a legal citizen and such - legal heritage player
That's the gist of it. CAS will have to determine if FIFA can contest a legitimate document from Malaysia in favour of another document issued by another country.
FAM has legitimate evidence, being a birth certificate issued by the government of Malaysia. CAS cannot claim the document is fraudulent because it isn't, CAS cannot compel the Malaysian government to retract it, because its just a sporting court. They can only determine if the FIFA rulebook allows FIFA to ignore the Malaysian birth cert in favour of the Dutch birth cert.
FIFA's case is - well, they have the original birth cert so there was a conspiracy to commit fraud to obtain Malaysian birth cert.

But obviously they don't layan. So now the only way is to go to CAS to argue - FIFA can argue that based on the original birth cert - fraud occured while FAM will argue - based on the Malaysia issued birth cert - no fraud as the government has acknowledged them as Malaysian, and CAS must only look at that angle.
