 Chase commercial tenant to pay rent

I am helping an uncle to chase this tenant to pay rent.

Contract say pay by 10th, but today is 23rd...

My rule of thumb is tenant cannot owe more than 1 month, otherwise evict.

Its a small commercial lot in a small shopping mall.

This tenant appears to have closed his hp, after I tried calling numerous times and sent watsapp reminders.

Any options?

If in event tenant owe > 1 mth, I evict...can I hire a lawyer to write a simple letter to tell them to go?

Other than that, is there a cheaper way to evict ? I don't want to take 6 months and get a court order costing me 6k, jsut to evict.

No need lawyer letter. As a landlord, issue a letter asking to settle all outstanding rental arrears, plus a confirmation whether the tenant wish to continue to rent.

Give 7 days notice and if the landlord don't received a reply, terus masuk unit.

1 letter to registered address, 1 letter paste on the premise, 1 through WhatsApp or email.

residential just cut the condo access card.

planning to do soon as the property is some distant to where i live

Important thing is the fella already past the 10th date.

I am very strict on this, cannot > 1 mth, else evict

the MO said they don't facilitate chasing rent.

My calls to the tenant has not been answered

better arrange to go quick, doesn't matter past the 10th or wat, since calls kena block dy

Residential got laws protecting the tenants. Need to use the court to officially kick them out.

Commercial can just use lawyers or strong-arm tactics to evict tenants.

If no reply from tenant, what you gonna do ? You don't want to spend money on lawyer. You just can't leave it 'occupied' with no rental.

All tenancy agreement are under contract act. It applies to all types of tenancy.

no rental paid, I will evict.

Of course, I won't let the tenant use that rent free.

but how to evict by legal law ?

Can obtain court order more cheaper n easily than residential?

I am not sure about eviction legal fees as I rather keep and use the money when the tenant ever sue me for 'illegal eviction' 😂

Logically, is better the tenant use the legal fee to pay rent and cont to rent instead of suing the landlord.

what does your rental contract say about non payment, exit clause
eg. if rental is not received in full by xxx day of the month for continuous xxx months, this contract is considered null and void.

something like that?

i see malls they put up notice on the door by landlord if no pay in x month, shall commence clearing. Mall side usually have contract that the shop must open by 10am and close by 10pm also.

usually mall will assist as much as possible to maintain their reputation.

i would think it's best to inform them, so that they are aware.. imagine you and your uncle confront him at the shoplot and a commotion is started by the tenant!..
with your preamp warning, am sure they too will be around to ease the situation
