Hi, does anyone know whether an extension of an employment probation without an official reason stated in writing can be subjected to a payout to the employee? If there is any lawyer who can advise..
Case in point, employer extends the probation verbally at the end of the probation period without a letter stating pass or fail.
Trying to cover all bases before resignation is submitted.
Thank you.

QUOTE(knwong @ Jun 11 2025, 10:01 PM) What verbal reason your boss give? Some absolutely funny and weird reasons that are mind boggling that he mentioned it (these are just used as an excuse) and also some reasons like not completing as fast as he likes, but sometimes this require other parties response as well so have to factor in their response time.

QUOTE(Fantasia @ Jun 11 2025, 09:56 PM) If I am not mistaken, probation is not stated in our labour law. So legally speaking, "probational staff" should have the right of permanent staff unless it is stated otherwise in the employment contract. Then again, just because it is stated in the employment clause, it does not mean that it is enforceable legally In the contract, it is not stated what happens if there is an extension.

QUOTE(6942nole @ Jun 11 2025, 10:14 PM) sorry, you resigned and they said they extended your probation? No no, I have no mood to contribute further as an employee as a result of this probation extension. Would like to know if there is any money on the table if the employer did not issue a letter for this extension, because there is no letter yet and unsure if they will give.

QUOTE(knwong @ Jun 11 2025, 10:30 PM) Many work are dependent on other stakeholders. It's common everywhere Yes you still need to be accountable on the result. What the boss wants is for you to be proactive in chasing others up. Basically you are hired to think of solution, rather than stay nonchalant or complaining about it Basically the extension of probation is for you to demonstrate you can trusted and reliable when being handed those tasks again Alright point taken, I do follow-up, but it will take some time because many things to handle, maybe every few days or sometimes a week apart I'm a do-er and if I see something not right or something that needs to be improved, I will feel compel to do it. Anyways, like the poster above said, I don't get the support anymore and he supports my subordinates for the most ridiculous reasons.

QUOTE(ry8128 @ Jun 11 2025, 11:11 PM) Extension of probation only means 2 things: you dont meet expectations or your boss dont like you. Either way, its not good for you. So you must be open to find out where you fail and learn from it. No one in this world want to lose good employees. So if he/she is good, for sure they will confirm them as permanent employee asap, some even have early confirmation. Just ask yourself, if you have a good employee, wouldnt you do the same too? I know that, thank you for confirming for me, again.

QUOTE(Fantasia @ Jun 11 2025, 10:27 PM) How about the exit clause stated in the contract? Do you need to serve any notice once you tendered resignation? 2 weeks notice. Is it legal if there is no official letter of extension?
