The two Malaysians who pleaded guilty in January this year to conspiracy in the 2002 Bali bombings have returned to Malaysia, after nearly 20 years at the US’s Guantanamo Bay detention centre.

Home minister Saifuddin Nasution Ismail said the unity government received Nazir Lep and Farik Amin from the US “on the principles of human rights and support for universal justice”.

He added that the pair had been held at the Guantanamo Bay detention centre since 2006.

“The government has formulated a comprehensive reintegration programme specifically for the pair, which will cover support in terms of social services, welfare, and health screenings,” he said in a statement.

Nazir, 47, and Farik, 48, had been held in solitary confinement since their arrest by US authorities in Thailand in 2003 in connection with the Bali bombings the previous year.

In January, they were sentenced to 23 years in prison by a jury after pleading guilty to their role in the bombings under a pre-trial agreement. Under the agreement, they could be released after five years and repatriated to a third country.

Both men pleaded guilty to conspiring with the “mastermind” Indonesian Encep Nurjaman, also known as Hambali, to commit the Bali bombings in 2002 which killed 202 people.

Earlier today, Washington said US secretary of defense Lloyd Austin had notified Congress last month of his intention to repatriate Nazir and Farik.

The Guantanamo Bay detention centre was set up in 2002 to detain terrorist suspects after the attack on the Twin Towers in New York a year earlier.

PETALING JAYA: The two Malaysians who have been sent home after having been jailed in Guantanamo Bay for terrorism-related activities will continue to be monitored, with a comprehensive reintegration programme drawn up for them.

Mohammed Farik Amin and Mohammed Nazir Lep, both of whom were detained by the United States since 2006 at the notorious detention camp in Cuba, are back in Malaysia, Home Minister Datuk Seri Saifuddin Nasution Ismail confirmed.

“The government has drawn up a comprehensive reintegration programme for the two, which includes support services, welfare and medical screenings.

“The ministry also expressed its appreciation to all government agencies that were involved in the successful handing off process of the two Malaysians,” Saifuddin Nasution said in a statement yesterday.

Later in the day, Inspector-General of Police Tan Sri Razarudin Husain said the two showed positive behaviour and were open to being assessed and rehabilitated.

“They also stated their strong commitment to becoming progressive members of society.

“Everyone deserves a second chance and we will ensure they receive such an opportunity,” he said, adding that both were in good health.

They were grateful that they could return to Malaysia and eventually to their families, he added.

Razarudin said the police received both men yesterday after they were handed over.

They had pleaded guilty earlier in the year to being accessories in the 2002 Bali bombing that killed more than 200 people.

Both were held for years in the secretive overseas network of the US Central Intelligence Agency (CIA) after being arrested in Thailand.

They were transferred to the Guantanamo military prison in 2006, but the military did not formally charge them at the war court until 2021.

In 2006, they were transferred to Guantanamo Bay to face trial in a special security court which was set up by former US president George W. Bush after the Sept 11, 2001 attacks.

Also charged was Indonesian Encep Nurjaman, better known as Hambali.

In 2018, Mohammed Farik and Mohammed Nazir were charged with nine counts related to the bombing in the Bali nightclub that killed 202 people and the bombing of a hotel in 2003 where 11 were killed.

In their plea statement, both Malaysians agreed to testify against Hambali, the former leader of the Jemaah Islamiyah movement, according to a report in the New York Times.

The paper quoted Mohammed Nazir’s lawyer Brian Bouffard as saying his client planned to live a quiet life with his family.

Bouffard added that his client had been punished many times over for his long-ago involvement with the wrong people.

The paper also quoted Christine Funk, a lawyer for Mohammed Farik, as saying that he “looks forward to the opportunity to continue living a life of purpose, taking care of his parents and pursuing a career that best reflects his skills and talents”.

The three Bali bombers have been executed by firing squad for their involvement in the 2002 bombings



Bin Amin and bin Lep, who acted as money couriers after the 2002 bombings to support the terrorists involved in the attacks, had been in American custody since 2003.

In January, a military jury sentenced them to 23 years in confinement, not counting time served, after they pleaded guilty to conspiring in the bombings, murder in violation of the law of war and other offences.

A lawyer for bin Lep, Brian Bouffard, said the men were "gofers" who were not directly involved in the bombings.

The bombings of the Sari nightclub and Paddy's pub, in the Balinese party region of Kuta, killed 202 people including 88 Australians.

Bin Lep and bin Amin apologised to the victims and their families during the military court hearing in January. Bin Amin said he knew nothing about the bombing until after it happened.

Both men also said they were tortured while in US custody. The court was shown some of bin Amin's drawings, depicting him naked and shackled.

Mr Bouffard told the ABC his client had "paid a far higher price in torture and decades of indefinite detention than his peripheral role in the Bali bombings warranted".

"He has accepted responsibility for his role in moving certain funds connected to it and has expressed a deep heartfelt remorse for the horrific loss of life that resulted from it," Mr Bouffard said
