Based on the provision of Section 60D(1)(b) of Act 265, if the Public Holiday falls on a rest day, or any Public Holiday other than the eleven (11) Public Holidays stated above (overlapping Public Holidays), then the next working day shall be a public holiday in lieu.
60D. (1) Every employee shall be entitled to a paid holiday at his ordinary rate of pay on the following days in any one calendar year: (a) on eleven of the gazetted public holidays, five of which shall be— (i) the National Day; (ii) (iii) the Birthday of the Yang di-Pertuan Agong; the Birthday of the Ruler or the Yang di-Pertua Negeri, as the case may be, of the State in which the employee wholly or mainly works under his contract of service, or the Federal Territory Day, if the employee wholly or mainly works in the Federal Territory; (iv) the Workers’ Day; and (v) Malaysia Day; and (b) on any day appointed as a public holiday for that particular year under section 8 of the Holidays Act 1951 [Act 369]: Provided that if any of the public holidays referred to in paragraphs (a) and (b) falls on— (i) (ii) a rest day; or any other public holiday referred to in paragraphs (a) and (b), the working day following immediately the rest day or the other public holiday shall be a paid holiday in substitution of the first mentioned public holiday. UALA LUMPUR: The overlap of Malaysia Day and Prophet Muhammad's Birthday (Maulidur Rasul) on Sept 16 this year has led to the Human Resources Ministry recognising both as individual public holidays. In a statement on Thursday (Aug 8), the ministry said Malaysia Day, which falls on a Monday, is a mandatory public holiday. "It cannot be replaced with other dates. "Meanwhile, Prophet Muhammad's Birthday is recognised as an optional public holiday for employers in the private sector to observe as a general day off," it said. It added that private sector employers choosing to grant employees a day off for Prophet Muhammad's Birthday can do so on the following day, Tuesday, Sept 17. "This falls under Section 60D(1) of the Employment Act 1955. "They can also choose to substitute it on a day other than Sept 17, under Section 60D(1A) of the Act," the statement read. When will each public company announce their decision? Tenaga? Telekom? Air Selangor? Banking? Insurance companies? Whether Texas chicken still consider Tuesday as working day or holiday will affect whether there is a special offer price on certain meals.UALA LUMPUR: The overlap of Malaysia Day and Prophet Muhammad's Birthday (Maulidur Rasul) on Sept 16 this year has led to the Human Resources Ministry recognising both as individual public holidays.
