Kesian dalam akta not stated kah? Then u all no choice lo. That also if your company gazette maulidur as public holiday.

Just checked my company calendar got ganti, so is 4 days off yay

Based on the provision of Section 60D(1)(b) of Act 265, if the Public Holiday falls on a rest day, or any Public Holiday other than the eleven (11) Public Holidays stated above (overlapping Public Holidays), then the next working day shall be a public holiday in lieu.


60D. (1) Every employee shall be entitled to a paid holiday at his ordinary rate of pay on the following days in any one calendar year: (a) on eleven of the gazetted public holidays, five of which shall be— (i) the National Day; (ii) (iii) the Birthday of the Yang di-Pertuan Agong; the Birthday of the Ruler or the Yang di-Pertua Negeri, as the case may be, of the State in which the employee wholly or mainly works under his contract of service, or the Federal Territory Day, if the employee wholly or mainly works in the Federal Territory; (iv) the Workers’ Day; and (v) Malaysia Day; and (b) on any day appointed as a public holiday for that particular year under section 8 of the Holidays Act 1951 [Act 369]:



Provided that if any of the public holidays referred to in paragraphs (a) and (b) falls on— (i) (ii) a rest day; or any other public holiday referred to in paragraphs (a) and (b), the working day following immediately the rest day or the other public holiday shall be a paid holiday in substitution of the first mentioned public holiday.

If government apparently they no ganti
If private, depends the company gazette maulidur Rasoll as one of their 6 extra holiday or not. If got means ganti, if none means no ganti.

Usually the other 6 days depends on the type of the company, if multi racial usually

New year 1 day
Raya 2 days
cny 2 days
deepavali 1 day

If GLC, all counted, follow state

Depends, if is type M company, they maybe will gazette

New year 1 day
Raya 2 day
Korban 1 day
Maulidur 1 day
Awal murharam 1 day

You need to check with your company what is the extra 6 days that they gazette other than the 5 compulsory (merdeka, msia day, agong bday, Sultan bday/state day/federal day and labour day)

According to labour law company supposed to announce next year supposed which day holiday. If they didn't announce before the year start, they already commit offense against the labour law.

Afaik glc like Sime Darby Telekom tnb fully observe all holidays depending which state ur in.

Banks also same due to union

Mnc is mixed

Private is need announce

Gov is nope

Hence remember union is important and those in union are actually sacrificing their future for betterment of others because they will be marked by employers never to be promoted.
