 Condo property with no traceable owners

All property sifus here, I have a question, hope someone can answer. confused.gif

If a condo apartment owner has passed away and no next-of-kin can be found, what can the MC/JMB do?

Maintenance charges are piling up.

if we see those lelong unit also has high outstanding maintenance debts.

Look like nothing much to do.

If the owner pass away and once they didnt pay the installment (assuming bank loan still havent paid finished yet). It will go to the lelong process, and new onwer will buy and move in.

That's assuming the loan wasn't covered by MRTA/MLTA. It will definitely be a long drawn process for the JMB/MC to recover outstanding maintenance fees as they also need to stake a claim into the deceased's estate.

Who got authority to lelong the units? Must get court order?

normally the bank (chargee) which has the charge on the property will initiate the auction.
the proceed with first go thru bank first. balance will divided by the rest of the creditors

ask lawyer on the details bah... because need to submit details like proof of debts and calculate the overdue payment & some legal letter etc...

u cant proceed the auction as the bank has the charge

How long the owner passed away??

The condo have banks debts @ loans outstanding..

If yes, then banks take ownership & auction the unit...

If no debts @ fully paid. Then it's hard. Need to find the next of kin no matter what....

normally it's the banks have first authorities. then local council & in this lastly Condo Management.

but before all these.

needed to make public notice in Major newspaper & wait for those next of kin to claim the assets. Normally in 30 days period. No response. then take next action to lelong the units

Unfortunately, no debts.

Of course, now owe Parcel Rent and Assessment.

Owner passed away maybe 4-5 years.
