Hi all, My probation is 6 months. A couple of weeks before month 6th, I was informed that my probation will be extended due to some of my unclear working methods, even though I managed to complete all required tasks. The probation will be extended for 3 months First 2 months are used to gauge my improvement and 3rd month is to decide if I got to stay or not. Went through the Performance Improvement Plan (PIP). On 2nd month, was informed that I didnt passed all the criteria in the PIP. Even though I tried to explain the reason behind it (did all my due deligence and the result didnt turn out as required in the PIP) the hiring manager did not accept them. Hence, I'm given 2 options 1. To continue witht the PIP, which the manager foresee that I won't achieved any significant results for the following month. 2. Opt for change to other dept, that he will try to ask around. I'm definitely opting for 2nd option and HR is still waiting for my respond. My question is 1. Will I be able to negotiate for a severance pay (some money to cover my expenses as I would need time to get a new job) from the company if they wish to terminate by end of 3rd month? 2. If by 3rd month, there is no intake from other dept,Should I hand in my own resignation letter, instead of them terminating me? I'm afraid the termination will affect my future interview if they found out i ws terminated due to non performing when do cross checking with HR. Please advise me.. |

Seems that they're planning to let you go.
Best to start looking for work opportunity elsewhere. |

They will PIP 2.0, PIP 3.0, PIP 4.0.........
They r playing many games with u. U r underdog in this situation. Even though if u can pass PIP 1.0, 2.0, 3.0 very well. Faster find a job. It is better u tender than being terminated. This post has been edited by TaylorS8: May 2 2024, 12:36 AM |

Its crystal clear now that you and the company are not a good match. You need to throw in the towel and find something else which meets your skills, interests and personality at best. Good luck mate. foxx3001, vincentsiow, and 1 other liked this post

QUOTE(Meimei14 @ May 2 2024, 12:25 PM) Yes. I'm looking for jobs ready since the beginning of my PIP. Yes, IMHO that’s probably the wiser move. You can control the narrative with your resignation. A bit harder if you’re let go or worse, sacked…Means better for me to resign, instead of wait for then to tell me to go instead? |

Agree with others tat say they will keep on PIPing u, until you leave yourself. Either u wear thick face and play the game with them (which imho is wasting your time and energy) or go find another place to grow your career. And no they would not let u go as they do not seem to have a solid justification to do tat. Most probably your work performance is good just tat u got backstabbed by office politics tats why..... not sure how close you are with your current boss... just be honest with her that you will continue to work here till you get another job. give her / him a estimation time of 3 months. seek her / his permission to operate like this. it is a win win for both side... Meimei14 liked this post

QUOTE(williamjr @ May 8 2024, 08:43 AM) Once you are in PIP, they already have the reason to terminate you without any severance pay because you are deemed as a non-performer. They will have all evidences showing which things you did not achieve, etc. If you meet your KPI, it is debatable case then again, why go thru those trouble unless you are in Company for decade. Company will likely start to create 'evidence' to show you are non performer e.g. give you task that you wont be able to complete, issue letter to state the performance issues. |

There's nothing else you can do.
Have some dignity for yourself, forgive yourself, swallow the bitter pills and learn to move on (by finding new job). |

Thanks guys for your reply. At the moment,I'm applying jobs and sending out resumes. My boss didn't inform me when will be my last date. He never mentioned if I'm required to do hand-over of my current job to other people. My teammates are puzzled too. For me, another working day is a day with salary. I wish to leave too and to start anew again at a new place. Was never put under PIP in my 10+yrs of working life. But I need the money for expenses. Until my boss /HR inform me of my last working day, I will continue to work until I get an offer.🥲 HappyA_Q liked this post

QUOTE(Meimei14 @ May 1 2024, 11:25 PM) Hi all, severance pay is one for one year service. Even if you get the severance pay you are likely to get 1/2 month pay for 6 month tenure. Go check your employment contract My probation is 6 months. Hey guys.
Latest update. Had a session with HR yesterday. HR asked me to hand in my own resignation letter, instead of him uses the termination clause, which according to him will look bad on me in future. On the other dept, he seems encouraging but he kept mentioning how difficult or tough if I'm to go to new dept. Oh well, I decided to tender my resignation. During the session, he asked me a lot of questions trying to dig out info from me,hoping I will complain and voice my dissatisfaction. But I just keep positive throughout the session and not saying anything negative.he mentioned my positivity is my "friendnemy", which it will help or destroy me. 😅😅😅. Guess he is trying to provoke me. |

Do you have evidence HR asking you to resign? Did you know that in Malaysia, if you sue, there is a very high chance of you winning?

I had indirect experience with this scenario when I was still in the corporate world. But don't take my word for it. Just do a Google search and you will see employees winning more court cases than employers. |

Yes, in the PIP there is a declaration of underperformance and it is to be signed by the employee. If you signed, then you are unlikely to win any court cases. However, if there is evidence that you have been coerced to sign, you can still fight back. They have proof that you are not performing. Let's move on. When you go for next job interview do not bring out the PIP thing. And during this time please take a look why would you got into PIP, is it company politic issue or your own problem. If it is your own problem it is easy then, improve yourself by finding out what are the obstables to you to handle the job. If the PIP is purely on your company issue, then just leave it there. There are number of fxcked up bosses around. I was one of the worse employee during first and second job where I just worked couple of months then quit without second thought. But then I fall in a long time jobless and this given me a lesson that I have almost no money to survive. I start realise that it was my own attitude problem and I start improving my attitude by putting more effort and think positively. When I got into 3rd job, I given my best even though I do not like the job scope. After couple of years I join the current MNC company from a junior position. I like this industry a lot and I being top performance among the team. In 10 years I was from junior, senior, AM, M and now become head of department.
