Hi,
Just wanted to ask as I have this problem where the new condo management just came in and found out there was an overdue late payment interest not paid by the previous owner. I had owned this property for about a year-ish and have been settling all my dues timely.
The overdue charges were from the period before my ownership and had never came up in the billing statement of the previous MO. The new MO is chasing me to settle the dues and currently imposing this late fees in my statement.
Am I accountable for this despite it was during the previous ownership? Been arguing with the MO over this but they stubbornly insist I pay up and seek refund from prev owner.
Appreciate any feedback on this and thank you in advance.

Usually during the purchase time, lawyer will ask for statement and ask them to clear or they will contra it off the disbursement money. By right, it's not your responsibilities.

Was the overdue shown up in previous statement, its ex owner responsibility and the lawyer to ensure zero payable upon handover

you hire the same seller own to do the transactions? go back to the lawyer and ask them how they verify for clearance u paid for their services, and this is not acceptable.

In the purchase docs, any outstanding?
If none, not your problem.
If yes, the lawyer has to claim back or deduct from his fees.

Nothing was in arrears in the earlier statements. Just came up this year after the new MO did some reconciliation. Will engage my prev lawyer on this. Thank you for the recommendations.

Thank you for the recommendations. In this case not your responsibility. Lawyer will ask for statement during signing and it is proof of amount to be settled. Suggest to engage your lawyer for clarification so they will handle on behalf. Condo management needs to be responsible on their own accounting fault. Not to mention, the overdue amount shall be addressed to the previous owner not you so they will not able to sue or put you on CTOS. If they block your access card etc can sue them back.

Do step by step back check rather then put all the blame to lawyer.
Check with lawyer 1st, did they get a clearance from previous MO. If yes, then go take a copy of clearance letter and approach MO to clarify. If no, then lawyer need to settle the outstanding at their cost for failing to get clearance letter. If they refuse to pay up, then report to bar council.
If previous MO screw up accounting and lawyer did received clearance letter, then I suggest you pay rather then prolong the matter if the sum is not too huge. If too huge then ask new MO to seek payment from previous owner. If refuse, then u can take it to tribunal. Do take note tribunal have a max limit on claims.
Good luck.

If the lawyer got the statement from the JMB showing no arrears, then its not the lawyer's fault as it was the condo JMB which messed up by not recording the interest. Not every condo JMB will give clearance letter. If the amount is small, i suggest just pay up because it will be more frustrating trying to get in touch with a lawyer who closed the file 1 year ago and even more frustrating to have the lawyer contact the seller's lawyer to contact the seller to settle it and most likely the seller will jus ignore.
