Like I am restaurant owner. I already give proof I ask this person stop smoking but he still smoke and refuse to leave my restaurant.I've called police. Thus don't saman me.

If like this still saman me. We need to allow restaurant owner to use physical force to remove smoker from our premise and have legal immunity if they injured or died.

We Malaysians are never known for being civilly responsible.
This why enforcement of law is important.

Besides, it's hard to punish the smokers themselves since eateries dont typically id their patrons. And we don't want to make other patrons become vigilantes or have to fight for themselves. More enforceable to have the establishment liable.
It's easy enough for other patrons to submit a report by taking a picture of smokers.
It's also easy enough for establishments to defend themselves from inaction accusations by showing cctv footage on said time and date of them addressing the smokers. Persistent/aggressive smokers can have police be called upon them. Then the establishment can legally detain them until police arrive.
