 Can i charge lawyer/banker for delay in purchase?

I signed SPA for a freehold subsale landed property in Jan and partial loan repayment was done in May. But last week i just got the keys. There was a 1.5months gap between partial disbursement and final disbursement. Is it normal and if the delay is due to my lawyer/banker, can i charge the progressive interest to them?

you may engage a new lawyer to sue them if valid.

for subsale to complete normally takes around 3 to 4 months or longer if leasehold. maybe you can try ask them give you chronology of event and see from there what cause the delay. like above say..if delay from them you may complaint

Refer to SPA signed what the handover timeline….typically 3+1 months with the extension subject to mutually agreed interest, then get the timeline from both lawyer and banker to determine where the gap delay…..u should be charging the landlord instead

1st draw down/loan disburse till 2nd draw down/2nd loan disburse/payment usually take some time..

in total not including leasehold consent, 3-4 months are the standard completion...

the consent application normally 2-3 months before the 3-4 months SPA runs..

if u seller, u can claim interest lo..

if u are buyer u pay interest to seller lor, but once pay seller, u pay less loan interest lo..

give and take one one.. remember there are maintenance fees to be paid , insurance, quit rent and etc

1-2 months is normal.

no u can't charge it to them, that's the risk of buying subsale property with owner having loan.

tumpang tanya... if buying new projects, usually how long will the SPA / loan agreement get stamped after signing? The lawyer seems missing now LOL

Depend on the project, especially the sale admin / agent hide the very important information which is your project gottan ADPL already? SPA only can be sign & stamp once ADPL is came out. Soif let said the project you booked already get the adpl, then should be within 1 or 2 week after you sign the Loan offer letter, haha you know sale person and lawyer can get commision or business via every case they done, so their speed is very fast one. biggrin.gif

need to engage lawyer to sue another lawyer.

it is only 6 weeks, a little far fetch leh, what will be the financial loss.
not easy to win as the SPA lawyer could have ( come up with) good reason for taking it longer.

got may excuses, eg bank not release full info, previous owner have some doc missing, land office delay etc.

If got time and money to do all this, might as well use it to focus on how to reno the house and works toward a better home ba

Instead of suing lawyer, try to ask for discount from the previous owner side. You gotta lose some to win some.

Nonetheless, subsale usually like this. I got the same issue as you but previous owner waive off cuz he is kind haha
