Kuching : Mahkamah Tinggi Kuching menetapkan 15 Ogos ini untuk pengurusan kes saman yang difailkan oleh Datuk Seri Sulaiman Abdul Rahman Abdul Taib, terhadap ibu tirinya, Toh Puan Ragad Kurdi Taib.

RHB Bank Berhad turut dinamakan sebagai defendan kedua di dalam tuntutan injunksi itu.

Pesuruhjaya Kehakiman, Alexander Siew How Wai, menetapkan tarikh itu selepas sebutan pertama kes itu, hari ini.

Beliau turut mengarahkan kedua-dua pihak supaya mematuhi tarikh untuk memfailkan dan bertukar afidavit seperti yang dipersetujui oleh peguam masing-masing.


Kedua-dua pihak bersetuju untuk memfailkan pelbagai afidavit sebelum tarikh pengurusan kes dalam prosiding hari ini.

Selain itu, plaintif dan defendan turut berjanji untuk tidak berurusan atau menjual saham seperti yang dinyatakan di dalam penyata tuntutan itu sehingga tarikh perbicaraan seterusnya.

Sulaiman memohon injunksi terhadap Ragad dan bank pelaburan terbabit, dipercayai bagi menghalang pemindahan saham daripada sebuah syarikat kepada ibu tirinya itu.

Beliau adalah anak ketiga daripada empat anak Yang di-Pertua Negeri Sarawak, Tun Abdul Taib Mahmud hasil perkahwinannya dengan Allahyarhamah Datuk Patinggi Laila Taib.

Abdul Taib berkahwin dengan Ragad pada 18 Disember 2010 iaitu lebih setahun selepas kematian Laila pada 29 April 2009.

Sementara itu, hanya salah seorang daripada enam peguam Ragad, Shankar Ram, bercakap kepada media di lobi Kompleks Mahkamah Kuching, hari ini.

"Kami berharap supaya orang ramai tidak membuat sebarang spekulasi berhubung kes ini.

Sabar dan tunggu tuntutan balas," katanya.

Peguam lain termasuk yang mewakili plaintif bagaimanapun enggan memberikan sebarang komen.

Sulaiman sebagai plaintif diwakili peguam Alvin Chong dan Jonathan Tay.

Ragad, sebagai defendan pertama pula diwakili oleh peguam Alvin Yong, Shirleen Ong, Wong Chun Ming, Azlina Dahlan, Shankar Ram, Yu Ying Ying dan Russell Lim.

Defendan kedua, RHB Bank Bhd, pula diwakili oleh Tan Kee Heng dan Lesley Ling.

Taib Family At War Over Spoils From Sarawak – EXCLUSIVE!

Sarawak Report has gained exclusive information about an extraordinary ex-parte hearing which took place in the Kuching High Court on Tuesday to request an injunction to freeze 50 million shares in the major Taib family conglomerate CMSB (Cahya Mata Sarawak Berhad) pending further litigation.

The individual who had brought the matter to court was none other than Rahman Sulaiman Taib, the former Kota Samarahan MP and second son of the present Governor of the state of Sarawak, Abdul Taib Mahmud.

His lawyer, Alvin Chong, has frequently represented Taib family members and was made notorious by his detailing of their corrupt practices caught on camera in the undercover expose Inside Malaysia’s Shadow State.

The defendant is Sulaiman’s own stepmother, Ragad Taib, as well as RHB Securities which apparently handled a transfer of these shares from his mother Laila Taib’s estate (administered by his elderly father) into Ragad’s possession.

According to the details of the case it has emerged there is another as yet unspecified plaintiff, which is suspected to be another of Taib’s four children.

Critically, it appears that this attempt to freeze the shares was enacted without informing Ragad (hence the ‘ex-parte’ hearing meaning the other side was not notified) in an apparent bid to prevent her from cashing in on the extremely valuable acquisition – CMSB shares are currently worth just over one ringgit each.

Mysterious Estate that includes CMS shares
The untoward management of the deceased Laila Taib’s estate has long produced raised eyebrows in Sarawak, where Taib has ruled with an iron grip sucking up wealth through family enterprises since inheriting the position of chief minister from his uncle in 1981.

Much of that wealth has funnelled through CMSB which has acquired vast contracts and concessions thanks to its ownership predominantly by the chief minister’s own family, namely his wife and children. This family grip continues despite a dilution of ownership through a stock market launch.

When Laila Taib died in 20o9 the second largest tranche of 110 million shares in the company passed into her estate which was in turn directly administered by Taib himself.

The beneficiaries of that estate were cited as Taib and the couple’s four children, Jamilah, Abu Bekir, Sulaiman and Hannifah. However, some fifteen years later the distribution has yet to be made of those assets with Taib keeping a firm grip, at least until recently, on the estate.

Aside from the frozen inheritance all four children enjoyed further shares of their own.

The two daughters are the joint owners of the largest shareholder Majaharta Sdn Bhd (although the eldest Jamilah who has spent her adult life in Canada has seen fit to sue the Swiss NGO, Bruno Manser Fund, for suggesting she has profited from her father’s plunder of the state).

Oldest son, Abu Bekir, disposed of his own major shareholding in 2019, as documented by Sarawak Report at the time, most of those shares being apparently purchased by his younger brother Rahman Sulaiman.

Amidst signs of family conflict in the management of the company, Abu Bekir was later forced to stand down as a director amidst damning evidence of conflicts of interest. This decision was later stunningly reversed, allowing Abu Bekir to return to his post.

Hanifah’s businessman husband, Alsree Alwee, however remains ousted as Group Managing Director having fallen out with his brother in law over the issue. It means CMSB is now back under the control of the Taib brothers and, according to the latest shareholdings registered in the most recent annual report (above), Abu Bekir appears to have bought back the bulk of the shares he sold.

Shock Share Transfer

Meanwhile, the talk of Sarawak in recent months has been the apparent failing health and mental acuity of the family patriarch, the now Governor of the state. Taib was eased out of office and booted into the ceremonial role in 2014 following election reversals in the wake of the numerous kleptocracy scandals published by Sarawak Report.

Recently the elderly cancer survivor has frequently appeared confused in public, where he is increasingly seen to be guided and dependent on his buxom and fashion loving much younger Syrian wife, whom he married relatively swiftly in 2010, following the death of Laila.

There has been equal speculation about the likely poor relations between Ragad, who brought the two sons from her separate previous marriages over to Sarawak (where they have been favoured with economically useful ‘Bumiputera’ status) and her step-children who are all considerably older than she is.

A show of unity was put on last month as Ragad hosted an 87th birthday event in KL for her husband, attended by Jamilah and Abu Bekir. However, Rahman Sulaiman and Hannah are believed to have been absent and rumours have swirled about alleged suspicions of the children about Ragad’s controlling influence over her ailing husband .

What has now emerged through the court proceedings is that on 2nd June 50 million of the shares held in trust by the Leila Taib estate for her four children (i.e. nearly 50% of that inheritance) was transferred into the direct ownership of Ragad through RHB Securities.

Taib as the administrator of the estate is assumed to have signed off the transfer. However, this is argued to be in a direct contravention of Laila Taib’s will which had left the shares to be divided amongst her children.

In court, Alvin Chong was unable to specify the percentages for the division of those shares. However, plainly Ragad was not stated as a beneficiary in her predecessor’s will.

Was Laila, therefore, merely the titular owner of shares that were actually considered his own by the current head of state in Sarawak?

It is a question that the present legal spat ought to provide an answer for, with considerable implications in terms of how Taib’s claims about his family’s wealth are viewed and the legal status of Leila Taib’s estate.

The strongman has always attempted to argue that his close family were all self-made, as opposed to benefiting from or acting as proxies for corruptly acquired billions stolen from the state.

What Next?

The attempt by Rahman Sulaiman to injunct the shares without Ragad being made aware of his move appears to have failed. The court held back from a decision in the absence of her being informed or pleading a defence.

On the other hand, the judge did agree to a rapid hearing of the case ‘inter-parte’ (i.e. with both sides begin allowed to make their case) as soon as Monday 19th June.

That has given Ragad a window of some three days to attempt to offload, sell or mortgage the shares. That might be ill-advised and it will soon be clear if she has done so.

Sarawak Report has exclusively learned of these developments. We suspect however the Malaysian press will be widely represented when the case returns to court on Monday.

Key questions on everyone’s lips will be whether others are now controlling the visibly fragile and apparently often confused Governor of the state; whether he was entitled to contravene the terms of his wife’s will (having delayed passing on the shares for years) and who really owned the assets in the Laila Taib estate to begin with?

All these while CMS was under Datuk Syed who started electing his circle of friends into the board. When taib went senile, his children started returning and wrestling everything back and of course CMS and sacofa were the first thing they want back. Plus they did some audit and seems like CMS was badly managed financial wise.

All those who had close ties with Datuk Syed are now gone or placed under permanent cold storage.

“It is a travesty that Raghad and her two sons should be facing a future of extreme wealth and status that has been denied to so many genuine natives and, indeed, genuine Sarawakians,” Jaban said in a statement.

He said there are thousands of people born in Sarawak to native parents who remain stateless while Raghad and her sons are recognised as Melanau by race and Malaysian citizens after she married Taib.
“There are thousands more Sarawakians who are unable to inherit their ancestral lands from their native parents as they are the products of mixed marriages.
“But now we are facing the very real prospect that this Syria-born woman, with precious little connection to Sarawak other than an advantageous marriage, might walk away with a fortune in Sarawak’s wealth.

“Our current Sarawak government must prevent this from happening or face serious discord among the Sarawak people,” Jaban said.

He said applications for Sarawak’s native status come with very strict requirements, including knowledge of the culture and the language and longstanding connection to a community.
“This is verified in detail through interviewing and testing,” Jaban said, adding that in practice, the process is extremely lengthy, commonly taking up to 20 years to process.
“Clearly, Raghad has not only jumped the queue but also been given preferential treatment throughout,” he said.

Jaban said that even if native status is conferred by the NRD, the ownership of Sarawak native land requires both parents to be natives as prescribed under Chapter 61 of the Interpretation Act 2005.

He added that Sarawakians of mixed-parentage – meaning only one parent is a native – are denied the ability to inherit their ancestral lands by the Sarawak Lands and Survey Department.

Jaban said it would be a mockery of the rule of law and the right of all Malaysians for Raghad and her two sons to be allowed to inherit native lands as naturalised Malaysians and recognised Melanaus.
“I know so many people who have fallen foul of this,” he said, citing as an example a local-born farmer with one Iban parent who is currently leasing land because he does not qualify to inherit his father’s land in Lundu.

Raghad, now aged 43, was reported to have married Taib, 87, in 2010.

Taib first married Poland-born Lejla Chalek, who later adopted the name Laila Taib, in 1959. They had three children together before her death at age 68 in 2009.

Taib and Laila’s second son, Datuk Seri Sulaiman Abdul Rahman Abdul Taib who is CMS Berhad managing director, was reported by The Borneo Post last week to have sued Raghad and RHB Bank in a bid to prevent shares from an unnamed company from being transferred from a company to his stepmother.

The case is pending at the High Court.

Now if taib said he own d shares and d wife was just a proxy and can proof it, then technically he didn't do anything wrong when transferring the shares to his new wife. But of course by doing that, he is admitting his corruption, so i doubt thats d route that will happen

But then again if he has dementia like someone said, then anything goes i guess

CMSB - Behind The Taib Family Firm's Latest Announcement

The announcement last week of the retirement of Governor Taib’s son-in-law, Syed Ahmad Alwee Alsree, from running the family dominated CMSB came as no surprise to some in the know, who have observed a certain family jostling for position over several months.

The two Taib sons apparently wanted control back from Alwee Alsree, married to sister Hanifah, who has now secured her position as an MP in the family domain of Mukah. Perhaps the multi-millionaire heiress was starting to look a little too ambitious for her siblings?

The family firm cum stock-exchange bohemoth suffered a severe knockback in the days immediately after the election, crashing 30% in one day when it shareholders panicked as they feared that Taib, notorious throughout Malaysia for his corrupt kleptocracy, might be targeted for investigation following the arrests and charges filed against Najib, neighbouring Musa Aman and a swathe of their cronies.

After all, if the forces of law and order were to scrutinise CMSB and its major Taib family shareholders regarding the company’s monopolies and favoured treatment over the years the business would be carved up overnight.

However, so far, politics have intervened to save Taib’s skin for another day. Sarawak did not hold local elections at the time of the federal elections like everywhere else, leaving the state government intact and that establishment (ever the catspaw of the powers-that-be in KL) quickly flipped its loyalties to the new coalition led by Taib’s old political ally Dr Mahathir.

At which point CMSB shareholders appeared to regain their nerve… or rater rallied not least thanks to some distinct share transactioning, which was not referred to in the recent announcement on Alsree’s departure but can be detected through the Bursa Malaysia obligatory announcements on share transfers concerning major shareholders.

One brother sells and another buys

What is plain to see is that whilst elder brother Abu Bekir Taib has been selling off his vast CMSB shareholding in a relentless series of scores of transactions since well before the election (a pattern that mirrors his divesting of a number of his other assets in an apparent attempt to reduce his proven wealth) younger brother Rahman Sulaiman has been buying up those shares to become the dominant figure in the company.

Rahman Sulaiman crashed out of business and politics in Malaysia a decade ago, but has been recently seen around Sarawak again and is rumoured to be aiming to take back control of CMSB.

Scores of transactions over the past eighteen months have registered sales by Abu Bekir being followed by purchases by Rahman Sulaiman, often with purchases by EPF apparently taking place between the two.

Abu Bekir started divesting his shares at the start of 2017, beginning with the disposal of some 700,000 shares (below) leaving him with still a major shareholder with a commanding 87,521,756 shares to play with as he remained Deputy Group Chairman of the company:

Confirming Abu Bekir’s commanding position as a top shareholder at that time the 2016 Annual Report recorded him owning 80 million shares directly and a further 12 million through RHB Bank, roughly the same number as his brother.

These shares, together with shares still in the name of their deceased mother (shares assumed to be controlled by the Governor) and a company owned by their sisters represented at least 47% of the company publicly in the hands of the family.

The only other shareholders to hold over 5% of the company in 2016 were the Employee Provident Fund (EPF) with some 90 million shares and the Taib family’s ever reliable partner in business, the Sarawak Economic Development Corporation (a state investment arm long controlled by the decisions of Taib and still chaired by Taib’s brother in law).

Altogether these 6 entities owned over 56% of the entire company.

Over the following two years Abu Bekir’s sell off has relentlessly continued, with scores of transactions recorded. The result being that following the last recorded sale some two and a half years later on 1st July 2019 of 5,700,000 shares left Abu Bekir owning just a million direct shares in the company.

At a rough median price of RM3.00 per share that represents a divestment worth approximately a quarter of a billion ringgit by the Taib elder son in this particular family company:

On the other hand younger brother Rahman Sulaiman has been accumulating shares. Following his most recent aquisition at the end of September of this year his shareholding had increased to just over a hundred million shares in the company.

Another consistent buyer has been EPF, which as of this month had increased its holding to over 123 million shares – up from 90 million before the election. The other major institutional investor since Abu Bekir started divesting his shares has been none other than the scandal torn pilgramage fund Tabung Haji, which has increased its holding from 48 million to 104 million over the period.

Such a show of faith in the Taib family firm by these government controlled funds will have been integral to the stabilising of the company following last year’s crash – share prices almost regained their pre-crash levels by the start of this year largely to these massive transactions, benefitting Abu Bekir handsomely as he offloaded those final shares.

Over the past months however, they have plummeted down once more from RM3.6 to RM2.3, so once again Taib fortunes seem to have been at the expense of ordinary folk – in this case pensioners and pilgrims have lost out yet again.
