recently the JMB has started to clamp vehicles owned by the residents that are parked on visitors parking. the problem is, the sales team has promised future buyers that they can park at the visitors parking since every unit is only allocated 2 carparks. this has caused a lot of rift between residents and the policy making body in my strata development. who is at wrong here?
SnP only states that every parcel owners are entitled to 2 parking bays. Apartment regulation / bylaws did state that visitors parking are meant for bonafide visitors only and that overnight visitors parking need to apply for permission from the management.

Will need to refer to S&P Agreement. If it's not in there, there is nothing you can do.

Very simply - visitor parking would be only for visitors unless residents get special approval from management to park there Overnight or long duration.

Ikut House Rule. If house rule state you cant, then you cant. If they dint state, you can challenge them in court if you want. But high chance house rule already state.
Next you wait EGM or AGM to change house rule if you want.

Like that said upon management approval - some management will rent or sell them out as well. There is no strict ruling usually car park rules and reg will set by management and can be changed by management anytime.

JMB/MC is not in the wrong. The common properties are meant to be shared & enjoyed by all. The moment the parcel owner uses the common property as their own usage, that will defect the purpose of the common property to be shared & used by the visitors.
Hence, the argument why the owner cannot park at the visitor car parks are totally invalid & should not surface in the first place.
You just need to rent a valid car park lot from the management instead of abusing the visitor carparks.

This is your answer.
This restriction is good for the benefit of all. Else, your visitors will not have spots to park. Without restriction, residents may park there because: - it's nearer to lift lobby -lazy to drive to the proper spots -they have > 2 cars -they rent out their spots...

Give people an inch and they take a mile. You are not meant to park in the visitor spot permanently. It may be fine if you forgot something and need to dash up to your unit to take something or you needed to offload groceries etc. For a brief while then why not? But to expect to be able to park your third car in the spot permanently is asking for it so yea you are very much in the wrong.

This kind of thinking is exactly why we do not allow residents to park in visitors parking area. If no body think like this n no one complaint, the higher chance of the above is allowed.
