QUOTE(cubix @ Oct 3 2023, 10:10 AM) This is an extract from a facebook post. Can Condo unit owner Install Solar Panels on building Rooftop? A written reply by Condo Dr. Joseph Wong 30062018 I live in a condo in Selangor, I made a request for possible installation of Solar Panel on our roof which has the best sun. Solar supplier & installer now looking at the project and would keep them informed. The next thing I get is received a lawyer letter informing me Solar Panel on the roof “NO GO” JMB denies my request. Saying the roof is common property, JMB has no power to decide and give me the consent unless to convene an EGM meeting to seek all owner’s approval and I shall also bear all costs (RM 20K) for calling the EGM meeting if I insist. Can JMB deny my reasonable request? Is there any law (legal recourse) that would support me? Your knowledge will be appreciated. Thank in Advance Answer: NO, you cannot install Solar panels on the common area (the roof) YOUR JMB is RIGHT unless the majority of your fellow owners have given approval to your request to install solar panels on the roof. I am not a lawyer, please regard my advice as friendly. I am not aware of any law that would allow you as a condo unit owner to install solar panels (or anything else for that matter) on the common area. Have you proposed to the JMB if the Condominium as a whole would also be interested in install solar panels to supply electricity to all common areas? It is possible that the JMB could actually save some money on electricity bills on the monthly basis (after an initial investment) that would benefit all unit owners also. However, as an individual unit owner, it is highly unlikely that you as an individual unit owner can install your own solar panels on the common area. Landed property, you can do what you please but condo cannot. Hope you are clear. If you have any question to ask the consultant, please email your questions to gmsssb@gmail.com. But not posting it on Facebook. Thank you |
