Without middle man, without contract signed. So just fully refund with apologies plus compensation (can be in any forms it's up to you) for making so much troubles to this buyer.

you do know that oral agreements can be legally binding in the eyes of the law i.e. it becomes a contract, right???

1st talk nicely and give a valid reason to justify why you wan to cancel the deal

Then refund the deposit and please la be a nice human being and treat that buyer a decent meal you never know in the future you guys get the chance to deal again?

Im sure the other party will be considerate if you started off to communicate like a genuine person who man up in this fked up situation

how do you think a "he say, she say" argument is going to go.. if a large sum of $ is on the line, one should put things on paper instead. Thus this argument is purely academic.

I would go the white lie route. That means say i sent car for last minute inspection by my mechanic and found out the chassis got crack. Have to pull out the sale. Can?

Contracts which were made verbally are enforceable, he is just stating the potential legal implication of such an arrangement even if there is an absence of a written contract.

Court may deem that a verbal contract has been established as buyer already deposited the monies into TS account + whatever Whatsapp messages.

It is unlikely that the buyer will litigate because of the costs.

contra proferentem. u google this rule. so it mean when charge deposit xxx amount, this also will apply same to u if u didn’t comply. mean u return deposit plus compensate based on the same amount.

reason behind also he might be losing because of ur not fulfill ur promise to sell. like he decided to deal with u turn down other offer, and that other offer no longer available how?

I'm saying that using TS' example of communicating via social media, it's not considered verbal agreement. It's written agreement. I wasn't referring to your experience.
