 Resignation and notice period issue

Hi, I worked at this company for around 2 years.

Recently I received a new job offer and will start on end of April

The thing is my notice period is 2 months and I just inform the new employer that I can provide 1 month notice.

Now, the issue is I have submitted my resignation letter with 1 month notice.

So I asked the HR for my last date and they also informed me that I have to pay the remaining notice first before they can release for my March salary.

Question is: Is this a legal thing for company to do this? smile.gif

This is the first time that I've experience this. I plan to pay the remaining notice period once I start my new job.

so you know your current company notice period is 2 months in which i assumed you signed the contract as well but now you asking if that is legal?

If you are the company, do you trust that resigned staff will 100% pay you AFTER he left?

Just ask the company to deduct from your march salary.

Obviously they wont release the salary until u pay la. U sure run one la after this, dont say i will pay once i start new job.. whats stopping you from paying now? If you are going to pay it as soon as you start the new job?

Yes as long as it is clearly stated in your employment contract and employee handbook. They will most likely withhold your last month's salary in lieu of you leaving earlier as well. If you were clear on how long was your notice period, your future company might have offered to pay off for you especially if they need you quickly. But judging on how careful you take things such as notice period and the finer details of things, I doubt it as well.

Yes correct, deduct from March but after that, must see balance.

If it's huge company, they'll take it serious. They'll calculate your March salary, then deduct one month short notice. If balance is they owe you, you'll get it. If balance is you owe them, they'll send legal letter. You just have to pay them the balance, case closed.

If it's small company, usually they'll let go.
