Hi all,

I need some advice. I have been working with a talent solution firm, recently was announced my contract will end at the end of this month.

I still have 8 days of annual leaves left and I want to encash them. However the company is asking me to utilize the leaves.

In the job offer was clearly stated annual leaves are encashable under 2 scenarios:
1. Cessation of employment relationship under this contrat
2. If not availed annual leaves due to company request.

I need advice on how to proceed and if possible how to convince them to allow me to encash my leaves.

Worst comes to worst do I take them court?

Appreciate all the help.

ur letter of employment got write can encash? if got then u try check first.

https://www.malaysia.gov.my/portal/content/30761?language=my

then u type a letter to your company say by law as u check from this this this...ask them pay u. scare them first. but bear in mind u will burn ur bridge ever after. ur boss, hr and whoever got involve wont like ur style. if u r still young i would advise u connection is more precious than money. may come back handy in the future. but if u die die wan the money then u go for it lo

I have a feeling your company isn't earning a lot of profit, that's why they are asking you to just take the o/s AL and pay you the 1mth salary in full. I don't think they have the money to pay you 1mth salary in full + 8 days balance AL. Sounds like financial issue for the company.
