 Property Loan Agreement, Wrongly Prepared by Lawyer !

Hi all,

It has been a miserable week for me. Engaged in a zero-entry cost loan. Bank assigned a lawyer firm to prepare the loan agreement. Signed. One week later, was called up and told that the agreement was wrongly prepared and I have signed it ! Need to re-signed a new set of document. Some sort of title charge-discharge issue cauz my property is under construction.

I didn't feel right about it so I insist to get back all the previous agreements that I signed before I signed the new one. They told me that already 'buang' the old agreements and I can't get it back. End up I called up the boss, request for an official letter stating that the agreements dated xxxxx was wrongly prepared by the lawyer firm and now they prepare the new one ?


I still feel uncomfortable with this. I don't hv frens in legal. Any advise, please ? rclxub.gif

It's okay the redo it for u.I also recently bought a house but the lawyer is very proffesional have u paid the legal fees? You could ask for rebate with them due mistake made by them.

i am taking the zero-entry cost. so the bank will paid the legal fees. if i know this would happen, i rather find the lawyer myself. thought wnat to save the hassle, end up more hassles

Thanks for the info. i got the number in HBA but somehow i lost my way in the Malaysian Bar website and couldn't locate the number.

It is your right to demand back the old document signed, to prevent any unforseen circumstances, they can't simply 'buang' the document <-- lousy excuse and irresponsible. Even want to destroy, it must destroy in front of the customer.

You can complain to relevant authority and get your own lawyer to sort it out. Some money spent is worth if later found out troublemsome in the future.

Yea, you should ask them how they buang the documents. Is it shredded or just dump into the bin?

Anyways, sonicwave, dun be discourage by it ah. It's a new house. So be happy and move into happily. Dun let such thing mess up such a jovial occasion.

I hope LYN manage to help u out in some sense!

Just some minor hassle.

Be positive. Take it as learning experience. You might learn something in the process of dealing with it.

Like what johntxy said, I would have demanded for an explaination how the documents were destroyed. and get it black and white just for protection.

anyway better be safe than sorry. Dont play around with legal documents. smile.gif

hahaha. somehow i very pantang with the agreement thingy and then it happens. that's somehow i lose my coolness. should namo namo more to peace my mind .... btw, is that happening also to anybody else ? somehow few ppl i talked to, show one kind of face when I mention to them. seems like very rare case ?

Yes it's very rare case for legal firm to screw up. & as legal advisor they should know that it's against ethic that they throw all the docs. They should get your consent first as the one you signed is legal binding. What if some unscrupulous ppl use it for their pernonal interest. shocking.gif

well. just get a 2nd opinion from another lawyer, fren's cousin. Should be fine with the letter issued by the lawyer firm. Just curious though. wat's the potential worst scenario that might happen ? rclxub.gif

Most(if not all) loan documentation are in prescribed format and usually printed.
Would you remember what documents you have signed earlier which are now claimed to be destroyed?
Ask them to show you samples and see if they are similar docs that you signed earlier.
Now, what documents are you asked to signed in its place?..eg loan agreement, Deed of assignment, charge documents...etc.

Or is it the case of particulars were wrongly filled in, and you are signing another set of the same docs?

If you can give details, I may be able to offer some assistance.
