 Paternity leaves in Malaysia, is it a myth

Would appreciate if anyone that has recently taken such leaves to chip in some thoughts/constructive feedbacks if private sectors in Malaysia allow their employees to do so and how long is the paid period of it?

The only infos I gathered online was the 7 days paid PL has been approved by dewan rakyat upon tabling but such law hasnt passed the senate stage nor been gazetted formally yet. So would love to know clearly of my rights and position/the market practices before I approach my HR/team lead to talk things out.

Last but not least, if its all boils down to sole discretion of employers, does it mean I am at their mercy or if there is anything I could do to improve my situation and be entitled to such leaves?

*no PL stated in my employment contract, and no, recently there isnt any expectant fathers in the organisation.

You don't need to wait for government to enforce this. Just raise this matter with boss/HR. Yes it is at company discretion but employees welfare should be at the heart of their job especially now that there's no such PL policy is not yet in place

my place give 5 days of PL, to be taken within a month. Any day can, not necessarily lump sum finish all 5 days

yes my wife is in MNC and is entitled to 4 months paid with additional 2 months unpaid whereas I am working in some private sectors with non-existent optical/dental benefits, so it doesnt really look promising to me.

worst scenario I gotta clear AL instead.

No paternity leave for my company. Early this year I have to apply for annual leave instead. Private sector should give at least 3 days of paternity leave.

yea that sucks, wife is asking me to take 7 days at least. i asked around my friends the entitled ones are usually 2 days, and have to apply with childs birth cert, which is total bullshit, as we would be needed the most on the actual day of delivery itself.

Honestly we can't blame private companies that does not give longer period of paternity leaves in Malaysia.

Most of the first world countries have longer period of paternity leaves because of their low birth rates so their government needs to encourage their citizens to have more babies and hence more benefits.

Look at the birth rates in Malaysia. Some group of people make babies without any plannings at all. Imagine you are an employer and you have an employee that takes paternity leaves every year or once every two years.

Furthermore I have seen many cases where employees quit their jobs without any notices or you can say that they disappeared once they received their 2 months paternity salaries.

If not indicated in your employment contract, probably there is no such benefit in your organization. However, there is no harm asking your HR for confirmation.

If leaves are needed, best way is to take annual leave or unpaid leave.

I have 6 weeks paternity leave

In financial institution

Some MNC financial institution now recognize the need of PL

But slightly BS cause I end up WFH in confinement center for the 6 weeks leave as I don't have a backup

first child indeed and so yea inexperienced, will be checking into confinement centre for one month after delivery.

most wont have PL indicated in contract but rather mentioned in employees handbook. luckily HR and team lead are both ladies so I hope they would be more accepting of this.

thats nice man, yeah at least you get to wfh and be with her in times of her needs. 6 weeks for me would be too much to ask for as job nature doesnt allow wfh I guess.

Like you said, the 7-day long Paternity Leave benefit hasn't taken effect yet since the law hasn't passed the senate. The minimum currently is 3 days, I think. For anything more than that, you'll need to refer to what your company offers in your employment contract, or apply for more from your annual leave.
