Hi All Sifu,

As know the 2008 bugdet announcement that properties under 250k will discount 50% for stamp duty .

Do anyone know is this effective immediately or year 2008?

Bcoz banker told me effective on the announced date but legal firm told the different. rclxub.gif

Is the gazette out?

History has proven that it is prudent to make major decisions only after one has seen the gazette.

I'm in the process of buying a house and the stamp duty already given discount of 50%. The proposal is effective for sale and purchase agreements executed from Sept 8, 2007, to Dec 31, 2010.

To Ju-On, I think you need to change your lawyer.

I was told by my lawyer as well. The 50% is not effetive yet. She said the Housing Kementerian haven't issue official MOT letter yet.

The lawyer said, she will write rayuan letter once the MOT letter is out to Housing Kementerian.

You should call LHDN or Housing Kementerian?

Added on January 18, 2008, 3:50 pmThis is the feedback I received from LHDN today.

Tuan/puan,

Emel tuan/puan bertarikh 16 Januari 2008 dirujuk.Terima kasih diatas e-mel tuan/puan.

@hanif444,
Am afraid I don't know what the answer to ur question is - let's hope other forumers be able to help. Also, I thought the 50% discount is onli applicable to first house purchase.

50% discount applicable to 1 house per person, doesnt matter new or second hand house and its for a limited time only.
from my experience, by default they wont give you the 50% discount, you have to ask your lawyer to write to the tax office.

I bought my house cost RM213k. 50% stamp duty is waived by gov. My developer absorb the rest 50%. Total I paid RM840 to my lawyer. I just signed the legal documentation last monday.

To TS, yes the 50% stamp duty waiver already applicable

u should get the price list why he charge RM5000...
as my case, i bought RM308k, the land + stamp duty on developer side, definitely no more than RM6k...

do downpayment to developer need witness? even i sign S&P before stamping also no witness... duh... doh.gif

only the lawyer need to be witness while i signing the documentation for the bank side...
or maybe he means bank's lawyer no bear-ed by bank? maybe ask bank to finance the bank's lawyer fees into house loan if he means bank side...

the 5k charge, is it for the purchasing only? I can say that it is expensive. There is a standard percentage rate for the charge according to the value of the house. Mine, for Rm180k, the lawyer charge is around 3k something.

Hi there, appreciate if anyone here can explain to me about the timing on this stamp duty refund

when i sign the S&P 3 months back, my lawyer ask me to pay the full amount of stamp duty first and after if its got approve by the LHDN, he will refund to me the 50%. however, when i called him last week he told that i will have to wait for another one month to get the refund of 50 % on stamp duty.

As for the progress on the S&P process, last i check with the bank today they have confirm and will prepare the cheuqe for the last payment(balance purchase sum) to my loan lawyer, the cheque will be ready for collection tomorrow. So from here i assume by next week, i will be getting the key from the owner and complete the whole S&P process.

so my question is why next month? i assume i have done all the necesary process including stamping the deep of assigment, so why do i still need to wait for another month for the refund?

hopefully some one can explain to me the time line and who is involve in approving the refund here so i can have a more solid base before i go to my lawyer office next week, thanks

hi, i'm first time buyer. i'm buying from developer. the legal fees and snp are bear by developer. however while approaching bank (maybank), the officer told me i need to pay around 5k for "loan documentation fee", it started since 1 november 2009. is this similar to the stamp duty mentioned above?

The Transfer scale is this:
First 100k is 1%
Next 400k is 2%
Subsequent is 3 %

Let's say your property is RM240k. The calculation should be this
First 100k is 1%=1k
next 140k is 2%=2.8k
So total stamp duty for transfer is RM1k+2.8k=3.8k
Since it's below 250k and use it for the first time, then the stamp duty will be 3.8k/2=1.9k

Everyone understands??
THIS CALCULATION IS STRICTLY FOR STAMP DUTY FOR MOT/DOA ONLY!!! NOT LEGAL FEES!!!
