I had make my furniture purchase on March at Manja Living a.k.a Manja Furniture Design at Semenyih. I bought dining set from the boss Mr.Ang and he promise that I can get my dining set on end of May or begin of June. However when I contact him he said his supplier didn't deliver the dining chair that I wanted. After several discussion I finally requested refund for the chair price only. As he told me before I make purchase that the chair was RM250 each. So I requested to refund RM 250 each, but he told me after he check the sales order the chair only sell me RM200 so he only willing to refund RM200 for each chair. Here come our argument because in sales order it written whole dinning set is RM1650. So I then request since he said is RM200 and I said he told me is RM 250before I make purchase,then I requested to full refund instead of only the chair So we don't have to argue the chair price, but he refuse So my question is how can I get back the refund as RM 250 as he mentioned to me before. He refuse to refund to me if I insisted to get back RM 250 each and mentioned the sales order has a clause mentioned non refundable. Is it really that if the seller don't have stock and customers request to refund is still not refundable? Any ways that I can claim back without need to file a claim at tribunal?

I think you misunderstood him.

If you buy the complete set, the chair is special at RM200.

If like your reasoning, then many would have ordered a set and strip the purchase later on.

A per unit complete set is always cheaper than an individual unit purchase ... a norm in any industry.

If the seller is smart, he will tell you the table now cost RM850 and refund you the balance. I assumed is 4 chairs.

I don't know because he didn't write in the sales order. Now I feel like he tells me 250 when come to refund is 200. The feel like cheated by this seller. So in your opinion the way he calculate is correct and I should accept that?

No seller will write individual unit price in the sales order if is a set purchase..

As explained earlier, he is not cheating you. He reduced his profit margin to sell a complete set.

If you can wait, then you get the chair at RM200.

But the fellow don't have timeline when can I get the chair. Been waited for almost 3 months. How I gonna dine without my dining chair. Lol. If really like what you mentioned why when I ask him the price for chair and he only tell me RM 250 but he didn't mentioned if buy in set the chair is only RM200. If statement made clear at the first place then is ok la. That's why felt cheated. Also feel that it's not make sense to wait for chairs more than 3 months.

Anyone has experience before can advise?

His supplier will give him the same deal.

1. He didnt expect his suplier have no stock.

2. You didnt ask about individual purchase price from start. He will only tell you the price for complete set. No seller will like to sell individual item due to logistic problem. Colours may varies from batch to batch.

submit an inquiry to e-tribunal, they will tell you if can sue them.
but of course, u must have the prove, maybe a conversation history.

You can't expect to have the only answer you want here at forum, what orchard said could be true, if you really couldn't accept what the seller offer you only can go to tribunal. From my opinion the seller don't have any reason to cheat you as if he want he can simply say the chair only worth 50, 100, 150 or any lower amount than 200.

Thanks for your advice, however I don't wish to go to tribunal as it time consuming and not worth the effort. l'm looking for other solutions
