KUALA LUMPUR: The Federal Government is seeking almost RM1.7bil in additional taxes from former prime minister Datuk Seri Najib Razak for the years 2011 until 2017.

The Government, through the Inland Revenue Board (IRB), filed the lawsuit against Najib as the sole defendant at the High Court registry on June 25.

In its statement of claim, the Government said the IRB had sent an additional tax assessment notice via registered post to the defendant's house address in Taman Duta on March 25 but the notice went unanswered.

According to the notice, Najib must pay RM116,173,374.12 (for the year 2011); RM320,929,932.31 (2012); RM891,573,465.46 (2013); RM119,144,655.51 (2014); RM16,879,500.03 (2015); RM643,445.21 (2016) and RM346,471.41 (2017).

However, Najib's failure to pay RM1.47bil for the seven years within 30 days from the date of the assessment notice resulted in the first 10% increase, which is in accordance with Section 103 of the Income Tax Act 1967.

As Najib still failed to settle the renewed sum within 60 days under the same Act, a compounded 5% hike was added to the sum, said the plaintiff.

"The plaintiff has the right to recoup the income tax that is still owed along with the increases imposed on the defendant as a tax which is due to be paid," it said.

It added that until Friday (July 5), the defendant is yet to pay the amount owed.

The Government is claiming a sum of RM1,692,872,924.83 with a 5% per annum from the day of judgment until the sum is satisfied, costs, and any relief deemed fit by the court.

The case is fixed for case management on Monday (July 8) before High Court deputy registrar Erry Shahriman Nor Aripin.

You never deal with tax people before haven't you.

Do you know during najib era how the taxman come after your money? Especially right before the election, the way they collect tax is brutal.
Suka hati lhdn say that they "disagree" with your tax interpretation, "therefore I'm charging you backdated tax."

And the way tax works is you have to pay first, then claim back if it's proven inaccurate. Or go to court and ask for injunction. In any case, court cases take forever, and if you don't pay, you kena slap with interest.

Ini termasuk sumbangan dari Menteri Kewangan Arab Saudi dan putera Arab yang telahpun disahkan oleh pegawai bank dalam perbicaraan kes SRC.

“Wang yang diterima sebagai derma sebenarnya tidak dikenakan cukai. Begitu juga wang dari sumber asing dan dana politik. Tapi PH masih mahu denda saya,” kata Najib.

Kalau diperhatikan juga, nilai denda cukai terbesar adalah untuk tahun 2013 di mana akaun beliau menerima dana yang disebut RM2.6 bilion itu.

Pegawai bank juga telahpun sahkan dalam mahkamah bahawa dana ini telah dipulang kepada penghantar selepas empat bulan diterima.

Anehnya menurut Najib, wang diterima dari luar negara dan dihantar balik empat bulan kemudian dalam tahun yang sama pun dikatakan oleh kerajaan PH adalah pendapatan (income).

Menurut Najib lagi, sejak PRU14 , sudah ada banyak bukti di mahkamah dan dari penjelasan penerima dana bahawa semua dana yang diterima telah digunakan untuk projek kebajikan sama ada terus kepada rakyat atau program kebajikan melalui NGO dan parti politik.

Beliau memberi contoh, Jakel baru-baru ini menjawab iaitu bayaran kepada mereka dari akaunnya adalah untuk membekalkan kain jubah bagi semua program-program amal (untuk imam, tahfiz dan termasuk 7 ribu masjid-masjid di seluruh negara dan untuk bekalan kain untuk mangsa-mangsa banjir antara tahun 2011 dan 2014).

“Sepatutnya penggunaan dana untuk CSR boleh ditolak dari cukai tapi mereka tetap mahu denda saya.”

“Lagi menakjubkan ialah kerajaan PH telah dakwa saya di Mahkamah bahawa dana-dana yang saya terima itu adalah wang haram,” kata Najib.

Yang peliknya, LHDN bawah kerajaan PH pula anggap ini bukan wang haram tetapi “pendapatan sah” yang perlu dicukai pula.

Takkan wang yang haram pun kerajaan PH mahu cukai?

For the donation, must proved to LHDN that the money received is donation and if LHDN satisfied, then it will be exempted, if not will be taxable.

For the money from overseas, income tax act stated that all income derived in Malaysia and money rendered from overseas is taxable. Have to prove overseas money is income from foreign country or donation. Donation that is exempted from tax is from parents and loved ones as those are considered as gifts and had nothing to do with services rendered.

Whether illegal money is taxabe or not. Yes, illegal money earned is taxable, when found out is illegal money, LHDN will report it to relevant parties, not LHDN job to deal with illegal money, they just tax only.

Donation is legal.... does not equal to original source of donation is legal....

LHDN didnot tax on donation money, because the money is yet to prove by jib as donation. LHDN will estimate income tax payable from money received when not submit tax return form or found out submit wrong tax return.

Meaning, irb will track ori source of donation all d way to foreign soil? Check if they hv paid up their taxes and all?

How to prove money is donation? And it’s up to IRB to decide what’s acceptable, what’s not? What if out of the blue Bill Gates decide to pump $$$ into your personal account, simply becos he takes a liking to you. What criteria IRB will use to determine if you can/ x accept the money fr such wealthy strangeR?

The story mory is like this....

Based on SPRM (MACC) findings in 2016, the money was a voluntary donation from saudi..thus based on that fact LHDN didn't tax the money received as it does not fall under Sec 4 ACP 1967.

But now under PH, SPRM said there was no proof that the money was a donation from saudi prince..so based on the new fact, the money was treated as unreported income and therefore taxable

No. Irb only will check donation.. n determine if that donation is taxable. If yes then tax.

Then if corruption case or misuse relevant department like macc or police will act on it.

The thing is about 1MDB what Najib and Jho Low do to launder the money using a legal way and that's why people in *cough* s *cough* c investigate and still can't sumbat him with 1MDB case. It's a very complex scenario and exploit the law to the max

What Happens When A Person Is Declared Bankrupt?

Being declared a bankrupt means an individual will have plenty of restrictions imposed upon them. Below are what will happen once a person is declared bankrupt:

Appointed A DGI
Once declared a bankrupt, a person will be assigned to the Director General of Insolvency (DGI). The DGI will administer all of the individual’s assets and manage it to repay the outstanding debts. So once declared bankrupt, a person’s assets will all be put under the administration of the DGI.

Travel Ban
An individual who has been declared bankrupt will be unable to travel out of the country without written permission from the DGI or before obtaining a court order which allows the individual to travel overseas.

Limited Credit Line
Existing bank accounts will be deactivated and a bankrupt will be barred from withdrawing any money from their existing account. Aside from that, a bankrupt is not allowed to spend more than RM1,000 on their credit card or obtain credit more than RM1,000 from any creditor.

Assets Taken Away
Once declared a bankrupt, all of the assets of the individual will be managed by the DGI. So for example an individual’s house and cars will be taken over by the DGI who will then manage it by reselling it to repay outstanding debts.

Employment Restricted
A bankrupt will not be able to work in certain professions which have restrictions imposed by their professional associations or licensing authorities. Examples of the profession a bankrupt cannot be employed as are:

Lawyer
Quantity Surveyor
Accountant
Doctor

Aside from that, once declared bankrupt an individual may not act as a director of a company. A bankrupt is also not allowed to own a business or be part of a business ownership, so no entrepreneurship is allowed once an individual has been declared a bankrupt.
