 Am i entitled for my 13 months contractual bonus

Hey guys, I am planning to leave my company soon, and in my offer letter, i am given a 13 months salary throughout a year, payout is every 15 December as per employment period.

Question: if i am leaving today 10 June 2018, after serving 2 months notice, according to the clause below, am i entitled for pro rated 13month contractual bonus?

ask your HR. Some companies will give. Some only give upon completion of 12 months.

my company does not give.. only after 12 months full completion

No. You need to complete the year. the 13 month bonus is a sure fire way to keep people till the end of the year at the very least.

by doing so, they are bracing themselves for attrition in the month of march.

why ?

People wait till december only they think about tendering.

then they think, ah shit. jan / feb is new year and cny. so they wont tender also

in the end they tender and leave also probably march.

haha most Malaysian company wont give. To be safe make sure your bonus deposited into your account first then only you tender your resignation.

as per advice earlier go check with your HR or refer to the employee handbook if there is any.

Yes. My company gives 2 months contractual bonus by end of december. So if i tender on 1st Dec.. i will lose the 2 months bonus..

Most cases you're not entitled for it as long as you're not employed by the company by the payout day (yours is 15th December). However, there are also companies that will honour it to you via pro rated. There is no standard practice for this, it is dependent on company policy. Like everyone else says, check with your HR. They will be able to answer you.

Most likely you have to complete the 12 months cycle to be entitled to that.
Most cases, the two months notice period doesn't count as part of the 12 months cycle.

But it depends on company policies. Sometimes they are more relaxed on the rules.

If it's not stated in your contract, most likely you will not get thay 13th month.

When in doubt, contact your HR.

like many suggested, likely that you won't get it. you need to service the full 12 months to entitle to the 13th month bonus.

If you are resigning, you can forget about the 13th month contractual bonus especially when you have not even work your full year. If you need to tender for specific reasons, then just do so. If you procrastinate and stay for the full year, why decide to resign in the first place anyway. All the best.

Haven't heard or seen any who got their 13th month pay aka bonus without completing full 12 months service. So don't put up your hopes instead work on your commitment to your future company and work diligently for at least a year before thinking of jumping ship again.

My company gives pro-rated 13th month contractual bonus to those leaving who demand for it. If they don't ask then HR pun buat tak tau
