 My bad experience with unethical beautician, What victims can do to seek justice

Hi everyone,

My main goal opening this thread is so the victims know what to do and what is the options available if you suffered from facial skin issue after the facial treatment. There are many types of beauticians, mainly all of them are friendly and smiley when things is right, but what happens when something goes wrong after the facial. Some beauticians will admit, apologise, willing to pay Dr’s fees or try to make the customer feel better emotionally as the customer already suffering negative reaction after facial. Some will deny their fault, full stop. And some beautician, the most shocking type, will deny and even accuse back the customer. Then this type, you must be willing to fight and stand up for yourself.

I have sued a senior beautician who is also one of the Director of the company due to negligence. All this while, she ask me to use the proper channel (law) to solve this case, and when I officially file the lawsuit at Small Claims Court, then she said better for her to save lawyer’s fees.

- I knew this beautician a long time for normal facial. Went to her and was strongly recommend chemical peeling (CP) due to pimple mark. I ask her do I need it as my skin only pimple mark. Mislead me by saying CP no acid, and side effects only redness and peeling. Next day, my skin feels rough/bumpy, she brought me soothing gel. 10 days later, she said another round of CP is required to solve the issue, that 2nd time CP can remove the rough stuff on my face. I asked her what happening to my skin, she unable to answer.

- My skin diagnosed as dermatitis by doctors. And what actually happened after the 1st time CP is my skin is inflamed/irritated, and the beautician’s failure to recognize it, and put 2nd time CP makes my skin more irritated and tight (skin’s natural moisture and protective barrier is gone)

- She said not her fault. That Doctor also using her CP product. But doctor won’t put 2nd time CP on an inflamed skin mahh. Dr will recognize irritation and won’t damage it further.

It is just a waste of time to talk when one keeps denying and spinning the truth. Evidences, this is very important. I have photos before and after CP, my skin is smooth and only pimple mark before, and do not have skin dermatitis/irritation/inflammation during consultation and b4 CP. Other beauticians and beauty centre managers told me that CP have acid, and what the beautician did is wrong, she cannot put 2nd time peeling on an inflamed irritated skin after the 1st time CP. Doctors said side effects of CP is not only redness and peeling, and beautician must recognize complications and know to handle it when complications happen. My case is the beautician do not recognize it, and negligently damage it further by putting 2nd time CP.

Besides photos, you also need doctor’s records/reports, other beautician’s records/witnesses, just gather more evidences as possible. She is outside the doctor’s office but do not go in with me due to she is busy, she refuse to go meet Datuk Seri Michael Chong of MCA Public Complaints department when being requested by his assistant, and she choose to pay me back when all this while, she ask me to use law method to solve this case. One wonders why she talk so loud behind me but is so hesitant to face to face with me in front of authority (doctor, politician, judge).


What one can do when experiencing side effects/complications of facial treatments/meet with unethical beauticians:

- Go to Wisma MCA and meet with Datuk Seri Michael Chong, and see what they can do

- Go to http://npra.moh.gov.my/
I make a complaint with aduanproduk@moh.gov.my and after further investigation at their side, was told that the chemical peeling product used on my skin is No Notification/Not registered with MOH! (Ministry Of Health). The beautician even told me that doctors is using their product. Raids was conducted at their branches in Malaysia last year by Pharmaceutical Enforcement agency.

- Go to Consumer Tribunal Claims – this is not for compensation. This is only for refund/repair/replaced. You cannot get back any Dr’s fees via Consumer Tribunal

- Go to Small Claims Court (max rm5k). You represent yourself and the beautician needs to hire lawyer due to they are a company

Type a summary of your case and then go there and fill up necessary form. A hearing date will be email to you, and you have to serve the letter to the defendant. And then the defendant needs to serve you back their defence within a time period, if not case can be postponed.

You need to spend time and more time, and be persistent if you want justice. Prepare/gather all evidences. Do not be afraid to stand up for yourself/for the truth/for justice. The one who is guilty is the one who should be afraid. Customer won’t suddenly wake up with inflammation/skin dermatitis, important questions when and how it happen, what happen, backed up with photos evidences, as well as witnesses/experts.

I hope the info above can help bad facial treatment’s victims. I really do not want any gals be helpless and don’t know what to do, and these unethical beautician who is the one strongly recommend CP, who lied to customer CP no acid, who put 2times CP on customer’s skin and customer suffer from skin issue, and at the end, these type of beautician is the one accusing back that it is the customer’s issue. What a really scary world we live in when twist and spin can just be told, where is the conscience. I am fortunate I have evidences to show before and after as well as other evidences/witnesses. If I do not have any evidences, I can only watch helplessly.

The beautician even questioned me why don't I blame other beauticians and why doctors cannot cure me. I cannot simply blame other beautician because they are not the one causing me skin dermatitis. My skin dermatitis is right after 1st time and 2nd time CP. How can anyone go to sleep in peace by simply blaming others for the sake of blaming. As for why Doctors cannot cure me, they are doing what they can, I certainly won't blame doctors, they are helping me, not harming me. It takes just a little while to damage the skin, and the skin may never be back to the original state. Maybe the beautician can ask herself why the damage happen in the 1st place, and don't shift the blame to customer, doctors, and other beauticians. What a scary lady.


And ladies, be very careful what some beautician said during consultation. Doesn’t matter whether she is someone you know for a long time, or is a new beautician. Unethical beautician will mislead you and by the time you are told the truth by other beauty centre managers/doctors, it is too late. I have go through a long battle in search for justice, it is a really tiring journey but absolutely worth it. I hope no gals will fall victim to bad beauticians or go in circle not knowing what to do if they unfortunately meet with bad beauticians. No one, no one wants to walk in to a beauty salon with smooth healthy skin, and end up with skin disease/complications. God bless everyone.

Yeah, that's my point of opening the topic. To let ladies know what to do in case they encounter similar case as mine. I certainly hope u do not need to use any of the methods i list down, and that you won't experience meeting with a dishonest beautician.

When it just happen, I really do not know what is on my skin, told her and she brought me soothing gel. No improvement. Then went back to her, and she told me 2nd time CP is certainly needed to 'remove/shed' those rough bumpy stuff off my skin. I actually knew her for many many years, 10 years to be exact. So, there is a level of trust i have towards her. And further, she is not a junior beautician. She is a very senior beautician with roughly 15 years of experience and a Director of the company. What can I say, there is trust of me towards her because know her for so long and because she have many years experience.

The dishonesty already start during consultation. She choose to lie to me that CP contains no acid, and withhold information about the other side effects of CP. I only know more what is happening to my skin after seeing doctors as well as other beauticians/beauty centre managers who is very honest with me. I was told by them who is honest and ethical that CP contains acid, that I do not need any CP in the 1st place actually as my skin is healthy and smooth and just only pimple mark, and that CP have other side effects besides redness and peeling.

I understand where you are coming from. I just wish there is honesty during consultation. I just trust this beautician and she choose to lie to me at first, and then betray me back by accusing that I am the one with problematic skin when the truth is I walk in her salon with a smooth skin. N like i said, the whole point of me posting this case is to let ladies know what to do in case similar situation happen to them. I run in circles don't know what to do to seek justice. Called Befriender because I am really lost dunno what to do. Can only cry. I strongly don't want any ladies to go thru what I went thru. It is a very scary experience looking and listening to someone I have known for 10 years spinning, twisting, telling lies and accused the customer back.

What happened already happen. If my thread can at least create awareness to customer to be careful of what beauticians is explaining/saying, or help a victim from running around and wasting much much more time not knowing what to do, then at least this thread serve its purpose.

This is very helpful for those who feel lost and want to seek professional help with regards to similar issues (malpractice/negligence).

Everyone's skin is different, so just because something works for person A does not mean it will necessarily work for person B. This should be taken into account by both the client and the practitioner.

The above methods is just some of the ways of seeking justice. Another way is of course to hire a lawyer and fight it in a civil court. I actually went for a consultation with a very senior lawyer specialising in negligence case. I presented the facts and evidences and he is amazed with the evidences that I have gathered myself, and told me that I do have a case. At the end, I did not engaged his firm's services mainly because I do not know how long a civil case will goes on as well as the cost. If I am rich or have extra money to spend, no doubt I would have sue the beautician in a civil court and no need run around for other ways for justice.

You are very correct on the part that everyone's skin is different. The beautician said that other customer's skin is ok after using the chemical peeling treatment and that Dr is also using the chemical peeling product, but I hope that the beautician needs to lower her ego, and to understand that my skin actually do not need such aggressive treatment in the first place as told by other beauticians/doctors. Chemical peeling works for some people, but it also have side effects which needs to be advised and told. And when complications happened, the beautician needs to recognise it immediately and not cause further harm to the customer. A beautician's job is to maintain or improve a customer's skin, not to harm it.

For people who wants to go thru chemical peeling treatment, there is success story as well as not successful story. Do educate yourself or seek consultation with doctors first or at least maybe a few beautician's advise, as not everyone needs or suitable for such treatment. If your skin is under an honest, ethical and experienced person's hand, at least if bad luck/complications happen the first time, the good doctor or honest beautician will recognize and treat it and not harm it further. Everyone must know the side effects of such treatment, and not only be told the positivity of chemical peeling.

As for my skin condition, I am on follow up visit with skin specialist. Before the chemical peeling, my skin is soft, smooth, healthy and only with 1 pimple mark. And after the chemical peeling, my skin now is not smooth and not healthy. The skin's texture has change entirely. I will be awakened in the middle of the night with skin's inflammation/irritation/itchiness. I no longer take pictures/selfie under the sunlight in close range. Sometimes the skin is sore and more redness, sometimes is less redness. And whenever I touch/wash my face at night, only myself can feel the 'grains' on my face, and I try telling myself 'never mind lah'. I just cancel an outing because my skin is more inflamed/sore this few days. Doctors cannot promise whether my skin will be cured/be just like before chemical peeling, and I certainly do understand as damaged have been done. To make my skin be just exactly like before is near impossible.


I actually wish to get in touch with forummers who went thru side effects after facial, how they accept the texture's change of their skin, or what they do to be happier despite the side effects. Do PM me as I believe that the ones who go thru similar experience will understand each other more, and able to offer more support and advise to each other. I really appreciate all the comments in this thread, as well as words of support, thank you very much.

I am having similar issue and going to sue my beautician who burnt my skin with laser. It has been a month and I am living with scars. I had good skin and she tried laser on my acne and left with 4 scars. They are hyperpigmented. Initially she said it will go away in a week although I told her I am worried and I am a freelance actor. She kept lying and in the end dermatologist told me that the laser damaged my skin. She kept saying she did no harm and asked me try few other treatments and I told her how can I cause the scars were caused by her. Now I am going for small claim to pay for further treatment after see a specialist. I need to ask you few things about how you did yours as well.It was done without my consent and she claimed she is an aesthetic nurse with certificate so the doctors are lying to take my money but I am living with 4 scar spots and 1 month I have been crying alot. Hope you can help. Thank you!

Initially she said it will go away in a week although I told her I am worried and I am a freelance actor. She kept lying and in the end dermatologist told me that the laser damaged my skin. She kept saying she did no harm and asked me try few other treatments and I told her how can I cause the scars were caused by her. Now I am going for small claim to pay for further treatment after see a specialist. I need to ask you few things about how you did yours as well.It was done without my consent and she claimed she is an aesthetic nurse with certificate so the doctors are lying to take my money but I am living with 4 scar spots and 1 month I have been crying alot. I feel truly bad for you and understood perfectly when you said you have been crying a lot. The maximum claim that you can file at the Small Claims Court is rm5k. You need to have evidences that it is the laser treatment that cause your skin to be bad. You need to have:

- Before and after treatment's photos
- Doctor's report about your skin during your visitation to the Dr
- Any other records/evidences that show your skin's side effect is due to the negligence of the beautician

You said that she did the laser without your consent? Can you elaborate more on this? My case is the beautician lied during consultation just to make me agree for the chemical peeling. You need to be tough and willing to spend time if you decide to sue her at the Small Claims Court. Keep the dr's receipts. My case is I sue her less than rm5k, and I got back my money. She choose not to go to court due to she is too afraid to face me in the court. I have too much evidences and even Dr's record with me. I even dare her to show her shop CCTV which will show how she lied during the entire consultation. And of course no one is willing to show an evidence which is actually against themselves.

After the case ends, I still go to the Dr, but I pay those fees myself. I will be very glad to help you and guide you on the Small Claims procedures. But like I said, just be prepare mentally and also spend a lot of time because first, you need to just type down a summary of the case, and pass it to the counter while filing the case. Just a short summary will do. Then you need to go back upstairs to other counter and then to pay at machine. Prepare small changes (rm5 or rm10) as the machine won't refund back the money to you. If I not mistaken, around rm20 for the filing.

Then you will receive email on when is the court's date. You print out certain docs and go to Post office to send the defendant (the beautician) the docs that you are suing her. It is not normal post. It is registered post with Acknowledgement Receipt (AR). Once the postman has let the recipient sign on the AR, the AR will be sent back to you. You need to go to the Court again after you receive the AR. Basically, you need to spend time once you decide to file the case against the beautician. Don't worry about the procedures. It is not complicated. And you can ask the ladies at the Small Claim Court on what you need to do after you file the case. They will explain it to you.

Why do I emphasized on time repeatedly, is because on the day of the case, the case can be postponed due to various reason. One of it is , the defendant (which is a company), did not hire a lawyer. You go alone (which is fine because you are an individual), and the beautician go alone too, and the judge will ask for the defendant to hire a lawyer first. I went to the Small Claims Court to prepare myself before the date of my case, so I can see a few cases being postponed. One of the reason is because defendant didn't hire lawyer. Hi, I type on a piece of paper the summary of the case. And then went to the Small Claims Court to fill up your details and the one you are suing details, attach the summary of the case, and pay for filing. Then very fast I already got the Hearing date. I do not think you can download the form at the court website. You can contact the Small Claims court based on the number I provided earlier to ask. For small claims court, just prepare yourself the summary of your case.

As for your case, maybe you can try to go Consumer Tribunal. You can contact them and ask for guidance. The forms of consumer tribunal can be downloaded online.
