it's not access control to live, if I understand gamerscoreblog's post properly the aggressive checking of region is only for tv shows and movies. not for anything else.

proxy connections will not work cause your console's region will be checked to see if they are able to download the content.

The region lockout is only on the TV shows & movies marketplace. Game content you can still use the loophole, cause games aren't ruled by the freaking MPAA

Halo 3 beta is for online multiplayer only so even if it didn't need Crackdown to run a Silver account still wouldn't be able to use it.

some games always have a line active, ie Gears Of War, Crackdown to facilitate the drop in drop out game play and when the box detects that ur download will be stopped as well
